Somersett County fs: By Order of the Court of the Right honourable Charles absolute Lord and proprietary of the provinces of maryland &c held for Somersett County at dividing Creek the fifteenth day of June anno Dom one thousand seven hundred & twenty five [Came into the Same Court the Justices thereof Judicially Sitting; Certain Indians belonging to the Town of Broad Creek Commonly Called the Nanticoke Indians vizt King Toby Lolloway and whist and make Complaint that a Certain John Caldwell Jun.r Patrick Caldwell and Thomas Caldwell had abused them or appears by their Complaint &c] To the Sherr of Somersett County Greeting we Command you Immediately on sight hereof you take the said John Caldwell Junr Patrick Caldwell and Thomas Caldwell (and them Carry before one of his Lordships Justices of the peace in Somersett County to give security for their good behaviours toward the said Indians till Next ^August^ Court) and then safe Keep so that you have their bodys before the Justices of his Lordships County Court held at Dividing Creek the third tuesday of august next to answer the Complaint of the Indians afd and to do & receive what the Same Court Shall Consider of &c hereof your are not to fail at your perill and this Shall be your Sufficient power Wittness Samuel Hopkins Gent Cheife Justice of Our Said Court the 18.th day of June in the tenth year of his Lordships Dominion &c Anno Dom 1725 (p order) Thomas Hayward Cler Att which said third tuesday of august to witt the Seventeenth day of the Same month anno Dom One thousand Seven hundred & twenty five being the day of the return of the said Writt Cometh the Sherr of Somersett County and Maketh Return thereof Endorsed in these words following viz.t according to ye within Writt to me directed I have arrested the Bodys of the Within Named John & Thomas Caldwell whose bodys I have ready to answer but Patrick in this Writt Mentioned is not to be found in my Bailywick so answers Jos: MccClester Sherr Whereupon the said John and Thomas Caldwell in their Own proper persons appeared and the Said Indians present in Court and the Court haveing heard the severall allegations as well on the part of the Indians afd as on the part of the said John and Thomas Caldwell and Maturally Considered the same It's thereupon Ordered by the Court that the Said John Caldwell Jun.r and Thomas Caldwell give security for their good Behaviour dureing the Pleasure of the Court thereupon the Said John Caldwell Junr and Thomas Caldwell present in Court acknowledged themselves to Owe and Stand Justly Indebted unto the Right honrble the Lord proprietary his heirs and Successors in the Sum of thirty pounds Sterling Each to be Levied on Each of their Boyds Goods or Chattells Land or tenements ^seperatly^ for the Use of Lord proprietary In Case the Said John Caldwell Jun.r and Thomas Caldwell are not of the good Behaviour toward all his Lordships Leige People and More Especially to the afd Indians Called King Toby Lolloway & which Likewise John Caldwell Sen and Thomas Gordan both of Somersett County Gent Present here in Court undertakes for their said Caldwell Jun.r and Thomas Caldwell or their securitys and acknowledged |
