to Command you to take the body of the said John Hope into your Custody and him safe Keep so that you have his body before the Justices of Somersett County Court to be held at Dividing Creek the third tuesday of august next to answer unto the above Complaint that he may be delivered by due Cours of Law hereof fail you not at your perill and for your so doing this shall be your sufficient authority and Power given under our hands and seales this day and year afd John McClester (seal) John Handy (seal) Att which said third tuesday of august anno Dom one thousand seven hundred & twenty five appears here in Court the said John Hope in Custody of the Sherr of Somersett County into whose Custody was Committed for the Cause afd And thereupon the said John Hope is again Committed into the Custody of the Sherr of Somersett ^County^ untill for the Caus afd untill he deliver himselfe by due forms of Law &c Whereupon the said Sherr Present herein Court took Charge of the said John Hope accordingly &c Whereupon it's ordered by the Court ^that^ Joseph Wailes, Henry Windsor, James Bounds & Sarah Dashie^ll^ all of Somersett County give Recognizance in forty pounds Sterr Each for their appearance before the Justices of assize Nisi prius Oyer and terminer and Goal delivery at dividing Creek the first tuesday of september Next to give Evidence on behalfe of the Lord proprietary against John Hope &c Thereupon the said Joseph Wailes, Henry Windsor, James Bounds and Sarah Dashiell all present in Court in their proper persons acknowledged themselves to Owe and Stand Justly Indebted unto the Right honrble the Lord proprietary his heirs and successors in forty pounds sterr Each to be Levied on their Bodys goods and Chattells Lands or tenements for the Use of the Said Lord proprietary In Case they do not make their personall appearance before the Justices of assize Nisi prius Oyer and Terminer and Goal Delivery to be held at Dividing Creek the ^first^ third tuesday of August September Next to give Evidence on behalfe of the Lord proprietary against John Hope and not to depart the same Court without Leave ^of the said Justices^ &c
of the Peace for Somersett County William Robertson with his Securitys James Train and Samuel Mellson all of the County afd and did acknowledge themselves to be Indebted to his Lordship the Lord proprietary viz.t William Robertson in the Sum of ten pounds Each a peice Like money afd (all) |
