        June Court           1725                 43

Own proper person present here in Court undertakes for the Said Patrick Daley that in Case
the Said John West shall recover Judgm.t in the plea afd against the Said Patrick Daley or
that the Said Patrick Daley shall be there in Convict that then he the Said Patrick Daley shall
pay the Condemnation of the Court thereupon or render his body to the Custody of the Sherr of
Somersett County in Satisfaction thereof or that he will do it for him &c

                   Whereupon the afd Patrick Daley in his own proper person Comes and defends
the force and Injury when &c and Says that he Cannot gainsay the plft his action afd
against him brought nor Can he Say but that the ^bill or^ writing afd is his act & Deed & that the debt
therein Mentioned is Yett due and Unsatisfyed wherefore the Said plft prays Judgm.t
for ^his^ the debt afd and his Costs and damages Sustained by Occasion of the detaining the same
debt to him to be adjudged &c
                                                    Therefore it is Considered by the Court here the fifteenth
day of June ann Dom One thousand seven hundred and twenty five that the afd John West
Recover against the afd Patrick Daley as well the Sum of thirteen hundred and fifty pd.s
(282)   of tobacco his debt afd as also the Sum of Two hundred & Eighty Two      pounds
of tobacco for his Costs and damages sustained by occasion of the detaining the same debt to the
same John by the Court here of his Assent adjudged and the afd deft in Mercy &c

     Command was given tot he Sherr of Somersett County that
he should take Nathaniel Horsey Horsey Late of Somersett
                                              County Mariner al.s dictus Nathaniel Horsey of Sumersett County in
                         the province of maryland Marriner if he Should be found in his Bailywick and him
    Should Safe Keep so that he might have his Body before the Justices of his Lordships County Court
    of Somersett to be held at dividing Creek the third tuesday of June then next to answer unto Mathew
    Tilghman ward of a plea that he render unto him the full seven pounds seventeen shillings and six
    pence Current money of this province which to him he owes and unjustly detaines &c    and that there
    of he should not fail &c
                                        Att which said third tuesday of June being the fifteenth day of the same
    month ann Dom One thousand Seven hundred and twenty five being the day of the return of the
    said Writt Cometh the said Mathew Tilghman Ward by Francis Allen his attorney and the Sherr of
    Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh return
    thereof to the Court here Endorsed Vizt   Cepi Corpus P me   Jos: MccClester Sherr

             Whereupon the said Nathaniel Horsey being Called appears and thereupon the said Nathaniel
    Horsey at the prayer of the plfts attorney afd is adjudged to give speciall bail to the
