       June Court            1725            42

County planter present here in Court in his own proper person undertakes for the said Michael
Holland that in Case the said Levin Denwood shall Recover Judgm.t in the plea afd against the said
Michael Holland or that the said Michael Holland shall be therein Convict that then he the said
Michael Holland shall pay the Condemnation of the Court thereupon unto the said Levin Denwood
or Render his body to the Custody of the Sherr of Somersett County in Satisfaction thereof or that he ye
said Michael Holland Jun.r will doe it for him &c

                   Whereupon the Said Michael Holland by George Dashiell his attorney Comes and defends
the force and Injury when &c  and Says that he Cannot gainsay the plft his action afd against him
brought nor Can he Say but that the writing obligatory afd is his act and deed and that the debt therein
Mentioned is yett due and unsatisfyed wherefore the same plft prays Judgm.t for his debt
afd and his Costs and damages sustained by occasion of the detaining of the same debt

             Therefore it is Considered ^by the Court here^ be the fifteenth day of June ann Dom One thousand seven
hundred and twenty five that the afd Levin Denwood Recover against the afd Michael Holland
as well the sum of one hundred and sixty pounds Curr.t money his debt afd as also the sum of four hundred
(409)    and Nine                               pounds of tobo for his Costs and damages by occasion of the detaining
the same debt to the same Levin Denwood of his assent by the Court here adjudged & the afd Deft in Mercy &c

                       Patrick Daley Late of Somersett County Labourer al.s dict Patrick
Daley was Summoned to answer unto John West of a plea that he render unto him
                            the sum of thirteen hundred and fifty pounds of tobacco which to him he oweth & from
       him he unjustly detaineth &c       And whereupon the same John by Levin Gale his attorney saith
       that Whereas the afd Patrick the Eighteenth day of June seventeen hundred & twenty four at Somrsett
       County afd within the Jurisdiction of this Court by his Certain Writting Obligatory granted himselfe
       to be held and firmly Bound unto the afd John in the Sum of thirteen hundred and fifty pds
       of tobacco to be paid unto the same John when he Should be afterwards thereunto Required yett
       the afd Patrick altho' often required the afd thirteen hundred and fifty pounds of tobo to the same
       John as yett to render hath denyed & Still doth deny whereby the Said John Saith he is worse &
       hath damage to the Value of five hundred pounds of tobacco and thereof he brings suite &c

                And brings hereinto Court the Writing afd which the debt afd in form afd doth testifie whose
       date is the same day & year abovesaid &c       L Gale P Quer Pledges &c Jno Doe R Roe

                Whereupon the said Patrick Daley in his own proper person appears and thereupon the
       said Patrick Daley at the prayer of the plfts attorney afd is adjudged to give speciall bail to the
       action afd      Thereupon a Certain Richard Plunkett of Somersett County Planter in his
