              June Court            1725             43

action afd   thereupon a Certain Revell Horsey of Somersett County planter present in Court undertakes
for the said Nathaniel Horsey that if in Case the Said Mathew Tilghman Ward shall Recover
Judgment in the plea afd against the said Nathaniel Horsey or that the said Nathaniel Horsey shall
be therein Convict that then he the said Nathaniel Horsey shall pay the Condemnation of the Court thereupon
or Render his body to the Custody of the sherr of Somersett County in satisfaction thereof or yt
he the Said Revell Horsey will do it for him &c

                   And the said Nathaniel Horsey by Allexander Hall his attorney Cometh & defendeth the
force and Injury when &c and saith that he Cannot gainsay the plft his action afd against him
brought nor Can he say but that the bill or writing obligatory afd is his act and deed and that the
debt therein Mentioned is Yett due and unsatisfyed wherefore the Said plft prays Judgm.t for his
debt afd and his Costs and Damages sustained by Occasion of the detaining the same debt to him to
be adjudged &c
                                       Therefore it is Considered by the Court here the fifteenth day of June anno
Dom One thousand seven hundred & twenty five that the afd Mathew Tilghmanward Recover against
the afd Nathaniel Horsey as well the sum of seven pounds seventeen shillings and six pence
(253)   Currant money his debt afd as also the sum of Two hundred and fifty three                   pounds
of tob.o for his Costs and damages sustained by occasion of the detaining the same debt to the same
Mathew Tilghman Ward of his assent by the Court here adjudged and the afd deft in Mercy &c


This third day of July 1725 Alexander Wordie surgeon made Oath before me that he attended the Court
on acco.t of M.r William Whittington's suite against John Olandman four days      Samuel Hopkins



                               The Court adjourn's till the third tuesday in August Next &c
