40 the Said John Onorton) By reason of the Speeking asserting Publishing and Decearing of which falce Malicious Infamous Scandalous & approbious words the said John Hudson not only in his Good name fame Creditt and Estimation afd is much hurt and Damnified But But also sundry sumes of mony and Tobacco for Clearing up his Innocency in that Pte is fourced to Expend Whereupon he Saith he is worse and Damages hath to the Value of forty Pounds Lawfull money of america and Thereupon he brings suite &c Francis Allen P Qrte Pleds depr John doe Richd Roe And the afd John Onorton by GEorge Dashiell his attorney Comes and Defends the fource and Injury when &c And Prays Leave to Imparle hereunto untill the Next Court and he Hath it and the same Day is Given to the afd John Hudson also Att which said Next Court to witt the fifteenth day of June Ann Dom One thousand seven hundred & Twenty five Came again as well the afd John HUdson as the afd John Onorton by there attorneys afd And the SAid John Onorton by his said Attorney as before defends the fource and Injury when &c And ^saith^ that he is not Guilty of the Premisses above Imposed on him in manner and forme as the Plft againest him hath decleared and for of this he putt himself upon the Country Dashiell P Deft and the Plft in Like manner Allen P Qrte Thereupon Command is Given tot eh Sherr of Somersett County That Immediatly He Cause to Come here Twelve &c by whome &c who Nither &c to recognize &c Because as well &c of which said Precept the Said Sherr to witt Joseph McClester Gentm Now here at this day to witt the Same day and year Last menconed Came and Made Returne that he hath here Ready Twelve &c as by his said Precept he was Command And Now hereafterwards to witt the same day and year Came again as well the ^afore^said Plft as the afd Deft by their attorneys afd and the Jurors of that Jury Therein Impannelled Being Called Likewise Came to witt Merrick Ellis, John Fleming, Robert Mitchell, Robert Mills, Thomas Peale, Robert Collier, John Townsend said John Tull, William Bratten, Joseph Houston, Thomas Collins, Charles Townsend who Being Duly Elected Tryed and Sworn to say the Truth in the Premisses and after the same same Jurors were By the Court Charged Concerning their Verdict and from the Bar here to Command together amongst Themselves of and Conserning their ^Giveing in of their^ Verdict afd In the Premisses afd did Reied and thereof amongst Themselves Being fully agreed Came again to the Barr to Give in that Verdict But the afd John HUdson Jun Altho' Solemnly Called Came not nor is the writt above said further Procecuted againest the afd John Onorton Therefore It is Considered by the Court the fifteenth day of June Ann Dom One (thousand) |
