33 seale of the said Nathaniel Signed hereinto Court brings that date whereof is the same day and Year did acknowledge himselfe to be bound unto the said Richard in the afd Eleven pounds two shillings and six pence to be paid unto the said Richard when he should be thereunto required yett the same Nathaniel tho' often required the said Eleven pounds two shillings and six pence to the same Richd hath not rendered but the same to him hitherto to render hath denyed & still doth deny and unjustly detain to the damage of the said Richard of ten pounds Money afd and thereupon he bringeth Suite &c F Allen P Qrte Pledges deft Jno Doe R Roe And the aforsaid Nathaniel Horsey in his own proper person Comes and defends the force and Injury when &c and prays Leave to Imparle here into untill the Next Court and he hath it & the Same days is given to the afd plft also Att which said next Court to witt the fifteenth day of June Anno Dom One thousand seven hundred & twenty five Comes again the Said Richard Bennett by his attorney afd and thereupon the said Richard Bennett by his Said attorney prays that the said Nathaniel Horsey to his declaration in the ples afd may answer but the said Nathaniel Horsey altho' Solemnly Called Comes not but makes default whereby the afd plft remains against the afd deft wholly undefended &c Therefore it is Considered by the Justices here the same day & Year Last Mentioned that the afd Richard Bennett Recover against the afd Nathaniel Horsey as well the sum of Eleven pounds two shillings and six pence Curr.t money of this province according to her Majesties Proclation his 349 Debt afd as also the sum of three hundred & forty Nine pounds of tobacco for his Costs and damages sustained by Occasion of the detaining of the same Debt to the same Richard Bennet of his assent by the Court here adjudged & the afd deft in Mercy &c
from him he unjustly detaineth &c And whereupon the same Levin Denwood by Levin Gale his attorney saith that whereas the afd Robert Hudson the twenty Ninth day of may Seventeen hundred and twenty two at the County afd within the Jurisdiction of this Court by his Certain Writing Obligatory Granted himselfe to be held and firmly bound unto the afd Levin Denwood in the full and Just Sum of One hundred & sixty pound Curr.t money of Maryland to be paid the said Levin Denwood when thereunto the afd Robert should be required yett the afd robert Hudson the afd sum of one hundred and sixty pounds Curr.t money of Maryland of any part thereof to the same Levin Denwood hath not rendered altogether often thereunto requried but the afd robert Hudson the same hitherto to the same Levin Denwood to Render hath altogether denyed and still doth deny and unjustly detaine whereby the (same) |
