32 the afd sum of five hundred & twenty five pounds of tobacco or any part thereof to the same Southy (altho' afterwards to witt the day and year afd at the County afd within the afd Jurisdiction the said Will.m was thereto Requested) hath not paid or him for it in any Wise Contented but the Same William the Same to the said Southy hitherto to pay hath altogether Refused and Still doth refuse whereby the same Southy says he is worse and hath damage to the value of Eleven pounds of tobacco and thereof he brings this suite &c L Gale P Quer Pledges &c Jno Doe R Roe
And the said William Harris by George Dashiell his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd plft also Att which said Next Court to witt the fifteenth day of June Anno Dom One thousand Seven hundred & twenty five Came againe as well the afd Southy Whittington as the afd William Harris by their attorneys afd and the Said William Harris by his Said attorney says that he Cannot gainsay the plft his action afd so as afd against him brought nor Can he Say but that the said Southy Whittington Ought to recover his damages by Occasion of the premises afd to five hundred pou and twenty five pounds of tob.o and Costs of Suite against him which the afd plft doth not Gainsay &c Therefore it is Considered by the Court here the same day & Year Last Mentioned that the afd Southy Whittington Recover against the afd William Harris his damages afd by occasion of the 274 premisses ^afd^ in form afd Confessed as also the Sum of Two hundred & seventy four pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this behalfe Laid Out & Expended & the with Stay of Ex.n till the tenth day of Novem Next & the afd deft in Mercy &c
of a plea that he render unto him Eleven pounds two shillings and Six pence Curr.t money of this province according to her Majesties proclamation which to him he Oweth & Unjustly detaineth &c And whereupon the same Richard by Francis Allen his attorney saith that Whereas the said Nathanill the Eighteenth day of Aprill Anno Dom One thousand Seven hundred & twenty att Somersett County afd within the Jurisdiction of this Court by his Certain Writing Obligatory which the said Richard with the (seall) |
