answer unto Adam Hitch of a plea of trespass upon the Case &c and that thereof he Should not faile &c Att which said third tuesday of march to witt the sixteenth day of the same month ann Dom one thousand seven hundred and twenty four being the day of the return of the Said Writt Cometh the afd Adam hitch by ^Levin Gale^ his attorney afd and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following vizt Cepi Corpus P Joseph MccClester Sherr Whereupon the said Sherr altho' Solemnly Called brings not in the body of the Said Adam Hitch Edward Johnson according to the Return of the writt in the plea afd And the said Sherr present here in Court prays further day untill Next Court to bring in the said Edward Johnson ^to answer &c^ & he hath & the same day is Given to the afd Plft also And the afd Adam Hitch declared against the afd Edward Johnson in the plea afd as followeth viz.t Somersett County fs: Edward Johnson Late of Stepney Parish in Somersett County Millwright was attached to answer unto Adam Hitch of a plea of trespass upon the Case &c And whereupon the Same Adam by Levin Gale his attorney Complaineth that whereas the afd Edward Johnson the tenth day of November Anno Dom One thousand Seven hundred & twenty four at the County afd within the Jurisdiction of this Court was Indebted unto the afd Adam in the Sum of Eighteen pounds three Shillings and two pence halfe Penny Curr.t money of this province as by an acco.t herewith in Court produced may appear and so thereof being Indebted the same Edward in Consideration thereof afterwards to witt the day and Year afd at the County afd within the Jurisdiction afd upon himselfe assumed and to the Same Adam faithfully promised that he the Said Edward the afd Sum of Eighteen pounds three Shillings and two pence halfe penny Curr.t money to the afd Adam when afterwards he should be thereunto requested he would well and faithfully Content and pay Nevertheless the said Edward Johnson his promise and assumption afd in form afd made Little regarding and plotting and fraudulently Intending the afd Adam Hitch in that part Craftilly and Subtilly to defraud & deceive the afd Edward the afd sum of Eighteen pounds three Shillings and two pence halfe penny Currant money or any part thereof to the afd Adam Hitch altho afterwards to witt the fifteenth day of November Seventeen hundred & twenty four at the County afd within the Jurisdiction afd he the said Edward was thereunto requested hath not paid him the said Adam for it in anywise Contented but the same Edward Johnson the Same to doe hath altogether refused and Still doth refuse whereby the same Adam says he is worse and hath damage to the value of forty pounds Currt money |
