(30) the same Ann to render hath altogeth^er^ denyed and still doth deny and unjustly detain whereby the same Ann says she is the worse and hath damage to the value of Eight hundred pounds of tobacco and thereof she brings this Suite &c L Gale P Qrte Pledgs &c Jno Doe R Roe And the said William Cottman by George Dashiell his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd plft also Att which said next Court to Witt the Sixteenth day of march ann Dom One thousand Seven hundred & twenty four Came againe as well the afd Ann Layfield as the afd William Cottman by their attorneys afd and thereupon the said William Cottman by his said attorney prayed further Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd plft also Att which said next Court to witt the fifteenth day of June Ann Dom One thousand seven hundred and twenty five Came againe as well the afd Ann Layfield as the afd William Cottman by their attorney afd and thereupon the said William Cottman by his said attorneys as before defends the force and Injury when &c and saith that he is not Indebted in Manner and form as the plft against him hath Complained and of this he putts himselfe upon the Country Dashiell & the quer Likewise Gale Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who Neither &c to recognize &c because as well &c of which said preceipt the said Sherr to Witt Joseph MccClester Gent Now here at this day to witt the same day and year Last mentioned makes return that he hath here ready twelve &c as by his said preceipt he was Commanded and now hereafterwards to witt the same day and year Came as well the afd Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Came Likewise Came to witt Merrick Ellis, John Dennis Sen, John Fleming, Robert Mitchell, Robert Mills, Thomas Peall, Robert Collier, John Townsend, John Tull, William Bratton, Joseph Houston, and Thomas Collins who being duely Elected tryed & Sworn to Say the truth in the premisses upon their Oath do say that the afd William Cottman is not Guilty of the premisses nor became Indebted to the afd Ann Layfield as she by declareing above against him hath Complained Therefore it is Considered by the Court here the fifteenth day of June Ann Dom One thousand seven hundred & twenty five that the afd Ann Layfield take Nothing by her writt & declaration afd but be in Mercy for her falce Clamour & that the afd William Cottman goe thereof without day &c Also it is Considered by the Justices here that the afd William Cottman Recover against the afd Ann Layfield the sume (628) of six hundred & Twenty Eight pounds of tobacco for his Costs and Charges by him about his defence in that part apposed to the same Will.m by discretion of the Justices here adjudged according to the form of the Statute &c |
