1724 (2) four hundred & ten pounds of tobacco so as afd attached ^be Condemned^ in the hands of the said Thomas Humphry's all of the Rights and Creditts of the said William King towards satisfying unto the sid George Hutchins as well the sume of four pounds four Shillings and seven pence halfe penny and four hundred & ten pounds of tobacco afd as also the Costs accrueing upon the Writt of attachment afd and that the said George Hutchins have his Execution thereof against the said Thomas Humphry's according to act of assembly &c
his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of march then next to answer unto Samuel Handy of a plea that he Render unto him three thousand pounds of good sound merchantable Tobacco which to him he Owes and unjustly detaines &c and that thereof he Should not fail &c And the Said Samuel Handy by Francis Allen his attorney proceeded against the Said Robert Macklinn in the plea afd as followeth vizt Somersett County fs: Robert Macklinn Late of Somersett County Plasterer al.s dict Robert Macklinn of Somest County and province of maryland Plasterer was Sumoned to answer unto Samuel Handy of a plea that he Render unto him three thousand pounds of good sound merchantable tobacco which to him he Owes and unjustly detaines &c And whereupon the Same Samuel by Francis Allen his attorney Saith that whereas the Said Robert the Second day of November One thousand seven hundred & twenty three at Somersett County afd within the Jurisdiction of this Court by his Certain Writing Obligatory which the said Samuel with the Seall of the Said Robert signed here into Court Brings the date whereof is the Same day and year did acknowledge himselfe to be bound unto the Said Samuel in the afd three thousand pounds of good merchantable Tobacco to be paid unto the Said Samuel when he Should be afterwards thereunto Required Yett the Said Robert tho' Often Required the Said three thousand pounds of good merchantable tobacco to the Said Samuel hath not Rendered but the Same to him hitherto ^to^ render hath denyed & Still doth deney and Unjustly detain; whereupon the said Samuel Saith he is worse & damage to the value of two thousand five hundred pounds of tobacco and thereupon he brings Suite &c F Allen P Quer Pledges deft Jno Doe R Roe A Copy of the foregoeing declaration was made and sent to be served on the deft within Writt in the plea afd Att which said nex third tuesday of march to witt the Sixteenth day of the Same month ann.o Dom one thousand seven hundred & twenty four being the day of the return of the Said Writt Cometh the said Samuel Handy by his attorney afd and the Sherr of Somersett County to whom the foregoeing Writt ^was directed^ Likewise Cometh & Maketh Return thereof to the Court here Endorsed in these words following vizt (Cepi) |
