(2) King by himselfe or his attorney appear and answer unto the said George Hutchins in a plea of trespass upon the Case &c according to Law and that by good and Lawfull men of your Bailywick you make Known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before the Justices of Our Said County Court to be held as afd to Shew Cause if any ^he^ she or they have why the same goods Chattells Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had & made according to the form of the act of assembly in that Case made & provided if to him her or them it shall seem meet and how you shall Execute this writt that you make Known unto Our Said Justices at the same day and place afd and have you then and there this Wittness Samuel Hopkins Gent Cheif Justice of Our Said Court ye 11.th day of December in ye 9.th year of Our Dominion &c ann Dom 1724 (G Dasheil) Thomas Hayward Cler Att which said third tuesday of March to witt the Sixteenth day of the same month ann Dom one thousand seven hundred and twenty four being the day of the Return of the said Writt Cometh the said George Hutchins by his attorney afd and the Sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following viz.t By virtue of the within preceipt to me directed I have attached in the hands of Thomas Humphryes as the sum of four pounds four shillings and seven pence halfe penny and four hundred & ten pounds of tobacco Costs before William Ralph and Thomas Parimore and Sumoned the said Thomas as Garnishee as by the said Writt I am Commanded Joseph M.ccClester Sherr Whereupon the afd Thomas Humphry's Garnishee of the afd William King altho' solemnly Called Cometh not but maketh default &c nor doth any other person appear for him to Shew Cause to the Contrary &c Whereupon the said George Hutchins by his attorney afd prayeth that upon giveing Security according to act of assembly that the money and Tobacco afd so as afd attached as of the Rights ^and Creditts^ of the said William King may be Condemned in the hands of the said Thomas Humphry's towards satisfying unto the said George Hutchings ^as well^ the Sume of four pounds four Shillings and Seven pence halfe Penney & four hundred & ten pounds of tob.o as also the Costs accrueing upon the writt of attachm.t afd and that thereupon a Certain Adam Hitch of Somersett County Planter present here in Court undertakes for the Said George Hutchings according to act of assembly that in Case the said William King do at any time within a year and a day appear and make all or any part of the Claim of the Said George Hutchins against him appear to be Satisfyed or otherwise to have been undue before the Laying of this attachm.t that then the said George Hutchins shall make Restitution to him the said William King of all or such part thereof as shall be made appear to be undue &c or that he the said Adam Hitch will do it for him Therefore It is Considered by the Court here that Sixteenth day of march ann Dom One thousand Seven hundred & twenty four that the said Sum of four pounds four Shillings and Seven pence halfe Penny and (four) |
