28 of abode of the afd deft Att which said next Court ^third tuesday of June^ to witt the fifteenth day of the Same Month ann Dom: One thousand Seven hundred and twenty five being the day of the return of the said Writt Cometh the Said William Pepper by his attorney afd and the Sherr of Somersett County to whom the foregoeing Writt Was directed Likewise Cometh & Maketh Return thereof to the Court here Endorsed in these words viz.t Non Est Inventus P: Jos: MccClester Sherr Whereupon the said William Pepper by his attorney afd prays that forasmuch as he has Complyed with the Law in Order to an attachm.t he may have Judgm.t against the Said Bowman Townsend for his debt afd by way of attachm.t according to act of assembly &c Whereupon for that it seemeth to the Court here that the Said William Pepper hath Complyed with the Law as alledged Therefore it is Considered by the Court here the fifteenth day of June Ann Dom One thousand seven hundred and twenty five afd that the afd William Pepper Recover against the afd Tobias Pepper ^Bowman Townsend^ as well the sum of Eight Pounds Nine Shillings Curr.t mony ^his debt^ afd as all Costs and damages sustained by Occasion of the detaining the same debt to be recovered by way of attachm.t against the goods Chattells rights or Creditts of the said Bowman Townsend according to act of assembly in such Case made & provided &c
province of maryland planter were somoned to answer unto Margarett Lady Baltemore Exrx of the Last will and testament of the right honrble Charles Lord Baron of Baltemore &c of a plea that they render unto her the full and Just quantity of Nine hundred and Sixty pounds of good sound Merchantable Tobacco which from her they unjustly detaine &c And whereupon the Same Margarett Lady Baltemore by Levin Gale her attorney saith that whereas the afd John Renchor in his Life time the twenty fourth day of November Sixteen hundred and Eighty Eight at the County afd within the Jurisdiction of this Court by his Certain Writing Obligatory granted himselfe to be held and firmly bound unto the afd right honrble Charles absolute Lord Baron of Baltemore &c in the Sum of Nine hundred and Sixty pounds of good sound Merchantable tobacco to be paid the said Lord Baltemore his Ex.rs adm.rs or assignes when afterwards the Said John should be thereunto required Yett Neither the afd John in his Life nor the afd Francis since his death the afd sum of Nine hundred and sixty pounds of tobacco or any part thereof to the same Charles Lord Baron of Baltemore in his Life time or the afd Margarett Lady Baltemore since the death (of) |
