27 said William hath not Rendered but the same to him hitherto to render hath denyed and still doth deny and unjustly detaine to the damage of the said William of tenn thousand pounds of tobacco and thereupon he brings Suite &c F Allen P Qrte Pledgs deft Jno Doe R Roe A Copy of the foregoeing declaration was made and sent with the Writt in the plea afd &c Att which said third tuesday of June of June to witt the fifteenth day of the Same month anno Dom one thousand Seven hundred and twenty five being the day of the return of the said Writt Cometh the said William Pepper by his attorney afd and the Sherr of Somersett County to whom the foregoing Writt was directed Likewise Cometh and maketh return thereof Endorsed in these words viz.t Cepi Corpus P Joseph MaClester Sherr And the afd Tobias Pepper in his Own proper person Comes and defends the force and Injury when &c and says that he Cannot gainsay the plft his action afd against him brought nor Can he say but that the writing Obligatory afd is his act and deed and that the debt therein Mentioned is yett due & unsatisfied wherefore the said plft Prays Judgm.t for his debt afd and his Costs and damages sustained by occasion of the detaining the same debt &c Therefore it is Considered by the Court that here the fifteenth day of June anno Dom One thousand seven hundred & twenty five that the afd William Pepper Recover against the afd Tobias Pepper as well the sum of five thousand pounds of tobacco his debt afd as also the sum of three hundred and Seventy (372) Two pounds of tobacco for his Costs and damages sustained by occasion of the detaining the same debt to the same William Pepper of his assent by the Court here adjudged & the afd Tobias in Mercy &c
might have his Body before the Justices of his Lordships County Court of Somersett ^to be held at Dividing Creek^ the third tuesday of June then next to answer unto William Pepper of a plea that he render unto him the Eight pound Nine Shilling Currant money which to him he Oweth and unjustly detains &c and that thereof he should not fail &c And whereas the said William by Francis Allen his attorney Saith that Whereas the Said Bowman the twenty first day of Novem anno Dom One thousand Seven hundred and twenty One at Somersett County within the Jurisdiction of this Court by his Certain bill Obligatory which the Said William with the Seal of the said Bowman Signed here into Court brings the date whereof is the Same day and Year did acknowledge himselfe to be bound unto the said William in the afd Eight Pounds Nine Shilling to be paid unto the Said William upon the afd tenth day of December Nevertheless the said Bowman the said Eight pounds Nine Shilling to the said William upon the afd tenth day of December hath not rendered but the same hitherto to render hath denyed and Still doth deny and Unjustly detain to the damage of the said William of fifteen pounds money afd and thereupon he brings Suite &c Francis Allen P Qur Pledgs deft Jno Doe R Roe |
