27 One thousand seven hundred and twenty five being the day of the Return of the said writt Cometh the said Joseph MccClester by his attorney afd and the Corroner of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed vizt Non Est Inventus decl.n Left at Last place of abode p Henry Ballard Corroner Whereupon the Said Joseph MccClester by his attorney afd prays that forasmuch as he has Complyed with the Law in Order to an attachm.t he may have Judgmt against the said Jonathan Raymond for his damages afd by way of attachm.t according to act of assembly &c Whereupon for that it seemeth to the Court here that the said Joseph MccClester hath Complyed with the Law as alledged Therefore it is Considered by the Court here the fifteenth day of June ann Dom One thousand Seven hundred & twenty five afd that the afd Joseph MccClester recover against the afd Jonathan Raymond as well the Sum of two thousand Nine hundred & sixteen pounds of tobacco his damages by Occasion of (380) the premisses afd as all Costs and Charges by the said plft Laid Out and Expended about his Suite by way of attachm.t against the goods Chattells rights or Creditts of the said Jonathan Raymond according to act of assembly in Such Case made and provided &c
tuesday of June then next to answer unto William Pepper of a plea that he render unto him five thousand pounds of Good and Merchantable tobacco which to him he ow's and unjustly detaines &c and that thereof he should not fail &c And the said William Pepper by Francis Allen his attorney declared against the said Tobias Pepper in the plea afd as followeth viz.t Somersett County fs: Tobias Pepper Late of Somersett County Planter al.s dict Tobias Pepper Planter in the County of Sommersett was Sumoned to answer unto William Pepper of a plea that he render unto him five thousand pounds of good and Merchantable Tobacco which to him he Owes and Unjustly detaines &c And whereupon the said William by Francis Allin his attorney saith that whereas the said Tobias the twenty fourth day of December ann Dom One thousand seven hundred & twenty one at Somersett County within the Jurisdiction of this Court by his Certain Bill Obligatory which the said William with the Seal of the said Tobias here into Court brings the date whereof is the Same day and Year did bind himselfe his heirs Executors and adm.rs to pay unto the afd William the afd five thousand pounds of tobacco the one halfe to be paid in the year twenty two and the other halfe in the Year twenty four in Country produce according to Markett Price at Snow hill Nevertheless the said Tobias tho' often Required the said five thousand pounds of tobacco according to the tenor of the said Bill unto the (said) |
