held at Dividing Creek the third tuesday of June then next to answer unto Joseph Pemberton of a plea of trespass upon the Case &c and that thereof he should not fail &c And the said Joseph Pemberton Complained against the afd Ebenezer Cook in the plea afd as followeth viz.t M.r Cooke You stand Justly Indebted unto me in the quantity of two hundred & and fifty pounds of tobacco and unless you appear at the next Court to be held for Somersett County at Dividing Creek the third tuesday of June Instant I shall sue for attachm.t against your Effects if any to be found in said County June 19.th 1727 To Mr Ebenezer Cooke J Pemberton in PPsance 1727 Mr Ebenezer Cooke Dr To so much paid Mr Jno Scott 250 tob Joseph Pemberton Jurat Incuriæ Thomas Hayward Cl A Copy of the foregoing Instrument of writing setting forth the Cause of action was made and sent with the writt in the plea afd &c Att which said third tuesday of June to witt the twentieth day of the same month ann Dom one thousand seven hundred and twenty seven being the day of the Return of the said Writt Cometh the said Joseph Pemberton in his proper person and the sherr of Somersett County to whom the writt in the same action was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt Non est Inventus short note Left p me Francis Allen sher And the said Joseph Pemberton in his own proper person prays that foras much as he hath Complyed with the Law in order to an attachm.t he may have Judgm.t against the afd Ebenezer Cook for his damages afd by way of attachment according to act of assembly &c whereupon for that it seems to the Court here that the afd Joseph Pemberton hath Complyed with the Law as alledged &c Therefore it is Considered by the Justices here the twentieth day of June ann Dom one thousand seven hundred and twenty seven that the afd Joseph Pemberton Recover against the afd Ebenezer Cook as well the sum of two hundred and fifty pounds of tobo his damages afd as all Costs and Charges by the said plft Laid Out and Expended about his suite by way of attachm.t against ye goods Chattells and Creditts of ye said Ebenezer Cook according to act of assembly in such Case made and provided &c |
