the records & proceedings thereof in our Court before our Justices at Dividing
Creek now remaining Manifestly appeareth & afterwards the afd W.m at Somrsett
Co.ty afd made his testam.t & Last will in Writing & Constituted Jn.o Blizard
Exr of his testam.t afd & afterwards there died ^after^ whose death the afd Jn.o Blizard
the Execution of ye testam.t afd upon himselfe took & ye Same testam.t
had in Lawfull form proved as on the part of ye afd Tho.s Fletcher in our
Court before us we have received Nevertheless Execution of ye Judgm.t afd as
yett remaineth to be done & because we are willing yt those things which in
our Court afd are rightfully acted Should be duely Executed   we Command
you yt by honest & Lawfull men of your Bailywick you Make Known
unto the afd Jn.o Blizard yt he be before our Justices of our County Court of
Somrsett to be held at Dividing Creek ye third tuesday of June Nextto Shew
if any for himselfe he hath or to say Knoweth wherefore ye afd Tho.s Fletcher
his Execution of the goods & Chattells which were of ye afd W.m Pepper
at ye time of his death in ye hands of ye afd Jn.o remaining to be administred
he ought not to have (according to ye forme form & Effect of ye recovery afd)
if to him it Seemeth Expedient & have you there then ye Names of them
by whom you Make Known unto him & this Writt Wittness &c

                   Att which said third tuesday of June to witt ye twentyeth day of ye
Same Month anno Dom one thousand Seven hundred & twenty Seven being
ye day of ye return of ye said Writt Cometh ye afd Tho.s Fletcher by his attry
afd & ye Sher of Somrsett County to whome ye foregoing Writt was Directed
Likewise Cometh & Maketh return thereof to ye Court here Endorsed in
these words following viz.t                  Made Known P Francis Allen sher

    And the afd Thomas Fletcher by Levin Gale his attorney prays that the afd John Blizard Ex.r
as afd to his writt afd may answer but the said John Blizard altho' so before warned ^being solemnly Called^ Comes
not but makes default &c

       Therefore it is Considered by the Court here that the afd Thomas Fletcher have his Execution ag.t
the afd John Blizard Executor of the afd William Pepper of three thousand three hundred and fifty
One pounds of tobacco his damages afd as also three hundred and Eighty Eight
pounds of tobacco to the same Thomas by the Court here adjudged according to the form of the statute
thereof Lately made and provided for his Costs and damages Sustained by Occasion of Delay of Execution
of the Damages afd of the goods and Chattells which were of the afd William Pepper at the time of his
death Remaining in the hands of the afd Jno Blizard to be administred if so much in his hands he hath
and if so much in his hands he hath not then the Costs afd Last mentioned to be Levied of the
proper goods and Chattells of the afd Jno Blizard &c
