he ought not to have according to ye forme of ye recovery afd if to him it seemeth
Expedient & have you there then ye Names of them by whom you made known
to him & this Writt wittness &c

             Att which said third tuesday of June to witt ye twentieth day of ye
Same Month Anno Dom one thousand seven hundred & twenty Seven being
the day of ye return of ye Said Writt Cometh ye afd Benj.a Wailes by his attry
& ye sher of Somrsett Coty to whome ye foregoing Writt was Directed Likewise
Cometh & Maketh return thereof to ye Court here Endorsed in these words following
vizt                                    Made Known P Francis Allen Sher

       And the afd Benjamin Wailes by his attorney afd prays that the afd John Blizard Exrs as afd
to his writt afd may answer but the said John Blizard atho' so before warned being Solemnly
Called Came not but made default &c

             Therefore it is Considered by the Court here the twentieth day of June anno Dom
One thousand Seven hundred and twenty Seven that the afd Benjamin Wailes have his
Execution of the Judgmt afd to be Levied of the goods and Chattells ^which were^ of the afd William
Pepper at the time of his death in the hands of the same John Blizard ^remaining to be administred^ Executor as afd if so
much in his hands he hath and if so much in his hands he hath not than the Costs and damages
afd Last mentioned to be Levied of the proper goods and Chattells of the Same Jno Blizard &c

memorandm the Plft by Levin Gale his attorney sued out his Lordships writt of
Scirefacias against the Deft the tenor whereof followeth in these words vizt
Somersett fs  Charles absolute Lord & proprietary of ye provinces of maryland
& avalon L.d baron of Baltemore &c  To ye Sher of Somrsett Coty
       Greeting whereas Tho.s Fletcher Lately in our County Court of Somrsett here to witt
       the Sixteenth day of Aug.t Ann.o Dom one thousand Seven hundred & twenty six
       before Sam.ll Hopkins Gent & his associates then our Justices at Dividing Creek in
       ye Co.ty afd & by Consideration of ye Same Court recovered ag.t W.m Pepper Late of
       Somrsett Co.ty Planter three thousand three hundred & fifty one pd.s of Tob.o for
       Dam.s which he Sustained as well by occasion of ye Nonperformance of a Certain
       promise & assumption by ye Same W.m to ye afd Tho.s Lately made as for his Costs
       & Charges by him about his Suite in yt part Expended whereof he is Convict as
