              And the afd Jos: MaClester by his attry afd prays yt the afd Price Collins
to his Writt afd May answer but ye afd Price Collins altho' before so warned
being Solemnly Called Comes Not but Makes Default

                Therefore it is Considered by ye Court here the twentyeth day of June
Anno Dom one thousand Seven hundred & twenty Seven yt ye afd Jos: MaClester
have his Execution against ye afd Price Collins of two thousand five hundred
& Seventy two pd.s of Tob.o his Damages afd as three hundred & fifty         pounds
of tob.o to ye same Jos: by ye Court here adjudged according to ye forme of ye Statute
thereof Lately Made & provided for his Costs & Dam.s Sustained by occasion of
Delay of Execution of ye Damages afd

 Memorand.m the plft by Levin Gale his attorney Sued out his Lordships Writt of
Scirefacias against the deft the tenor whereof followeth in these words vizt
Somersett fs    Charles absolute Lord and proprietary of the provinces of Maryland
and avalon Lord Baron of Baltemore &c  To the Sher of Somrsett County
Greeting whereas W.m Pepper Late of Somrsett County Planter
         to witt on ye Eighteenth Day of June Anno Dom one thousand Seven hundred
         & twenty five before W.m Fasitt & Jn.o MaClester Gent.m two of our Justices
of our County Court of Somrsett Confessed Judgm.t unto Benj.a Wailes (for as well
one thousand three hundred & Sixty one pd.s of Tob.o a Certain Debt as five hundred
& fifty Six pd.s of Tob.o which to ye Same Benj.a Wailes in our Co.ty Court afd
were adjudged for his Dam.s which he hath by occasion of ye Detaining
of ye Same Debt) according to act of assembly in Such Case made & provided
& ye Same Judgm.t so as afd Confessed in our County Court of Somrsett in ye month
of June & year afd was Inrolled & there before Sam.ll Hopkins Gent & his
associates then our Justices of our Same Court remaineth Inrolled (where of
he is Convict) as by ye records thereof in our Same Court before our Justices
afd at Dividing Creek remaineth Manifestly appeareth & afterwards
ye afd W.m Pepper in Somrsett Co.ty afd made his testam.t & Last will in Writing
& Constituted Jn.o Blizard of ye Co.ty afd Planter Ex.r of his testam.t afd &
afterwards there died after whose Death ye afd Jn.o Blizard ye Execution of
ye testam.t afd upon himselfe took & ye Same testam.t in due forme of Law
proved Nevertheless Execution of ye Judgm.t afd as yett remaineth to be made
as by ye Insinuation of ye afd Benj.a Wailes we have received & we being
Willing yt those things which before our Justices afd are rightfully done
& in our Court afd remaining upon record ought to be duely Executed we Command
you yt by honest & Lawfull men of your Bailywick you Make
Known unto ye afd Jn.o Blizard yt he be before ye Justices of our Co.ty Court
of Somrsett to be held at Dividing Creek afd ye third tuesday of June Nextto Shew
if yt for himselfe he hath or to say Knoweth wherefore ye afd Benj.a Wailes
his Execution of ye goods & Chattles which were of ye afd W.m Pepper (at ye time
