Wailes have his Execution against the afd Moses Driskill ^admr as afd^ of fifteen hundred and three pds
251   of tobacco his damages afd as Two hundred & fifty one                              pounds of tobacco
to the same Benj.a by the Court here adjudged according to the form of the Statute thereof
Lately made and provided for his Costs and damages Sustained by Occasion of Delay of Execution
of the Damages afd   if the said Moses Driskill hath so much good and Chattells which were of
the afd Edmond Hammond at the time of his death remaining ^in his hands^ to be administred and if so much
thereof in his hands he hath not than the afd two hundred and Sixty Seven pounds of tobo Costs
to be Levied of the proper goods and Chattells of the afd Dennis Driskill and also the Costs
accrewed ^on ye scire facias afd^ by occasion of Delay of Execution of the Damages to be Levied of the proper goods
and Chattells of the afd Moses Driskill &c

 Memorand.m the Plft by Levin Gale his attorney Sued Out his Lordships writt of
Scirefacias against the deft the tenor whereof followeth in these words vizt
Somersett fs  Charles absolute L.d & proprietary of ye provinces of Maryland
                         & avalon L.d baron of Baltemore &c To ye Sher of Somrsett Coty Greeting where
       Jos: MaClester Lately in our Co.ty Court of Somrsett hereto witt the fifteenth day of
       March Anno Dom one thousand Seven hundred & twenty five before Samuel
       Hopkins Gent & his associates their Justices of our same Court at Dividing Creek
       in the Coty afd) & by Consideration of ye Same Court recovered ag.t Price Collins
       Late of Somrsett County planter two thousand five hundred & Seventy two pd.s
       of tob.o for his Dam which he Sustained as ^well^ by occasion of ye Nonperformance
       of a Certain promiss & assumption by ye same Price to ye same Jos: Lately made
       as for his Costs & Charges by him about his Suite in yt part Expended whereof
       he is Convict as by ye record & prosess thereof in our Same Court before our Justices on
       Dividing Creek afd here being Manifestly appeareth Nevertheless Execution of ye
       Judgm.t afd as yett remaineth to be done as by ye Insinuation of ye afd Jos we have
       received & because we are willing yt which in our Court afd is rightly Done Should
       be duely Executed we Command you yt by good & Lawfull men of your Bailywick you
       make Known unto the afd Price Collins yt he be before our Justices of our Coty
       Court of Somrsett to be held at Dividing Creek ye third tuesday of June Next to Shew
       Caus if anything for himselfe he hath or to say Knoweth wherefore ye afd Joseph
       MaClester his Execution of ye Judgm.t afd against ye Same Price ought not to have
       according to ye form of ye recover afd if to him it shall seem Expedient & have you the
       & there ye Names of those by whom you make ye Same Known & this Writt Wittness &c

                      Att which said third tuesday of June to witt ye twentyeth day of ye Same Month
       Anno Dom one thousand Seven hundred & twenty seven being ye day of ye return of ye said
       Writt Cometh ye afd Jos MaClester by his attry afd & ye Sher of Somrsett County to whom ye
       foregoing Writt was Directed Likewise Cometh & Maketh return thereof to ye Court he
