       June Court                1725                26

said Joseph by Francis Allen his attorney Complaines that Whereas the said Jonathan the thirtieth day of November
anno Dom One thousand seven hundred and twenty four at the parish and County afd within the Jurisdiction of this
Court was Indebted unto the Said Joseph in four thousand three hundred & thirty two pounds of tobacco for Levies
Sherr.s fees and Publick dues to the said Joseph then and there due Oweing and unpaid as by an acco.t thereof
hereunto annexed may in Court appear and being so thereof Indebted the said Jonathan in Consideration
thereof afterwards to witt the day and year afd at the place afd in Consideration thereof upon himselfe
did assume and to the said Joseph then and there faithfully did promise that he the said Jonathan the afd
four thousand three hundred pounds and thirty ^two^ pounds of tobacco to the said Joseph when he Should be afterwards
thereunto requested he would well and faithfully pay and Content and altho' the said Jonathan
One thousand four hundred and Sixteen pounds of tobacco pcell of the afd four thousand three hundred &
thirty two pounds of tobacco to the said Joseph he hath paid and satisfyed yett as to two thousand Nine hundred
and Sixteen pounds of tobacco Residue of the afd four thousand three hundred & thirty two pounds of tobacco
the said Jonathan his promise and assumption afd in form afd made Little Regarding but plotting and fraudulently
Intending the said Joseph in that Part Craftilly and Subtilly to deceive and defraud the afd two thousand
Nine hundred & sixteen pounds of tobacco to the said Joseph he hath not paid nor to him for the same
in any Wise Contented altho' the Same to doe the said Jonathan by the said Joseph on the first day of
December in the Year afd and often afterwards at the Parish and County afd within the Jurisdiction afd
he was thereunto requested but the same to him to pay or in anywise to Content hath refused and still
doth refuse and deny whereupon the said Joseph saith he is worse and hath damage to the value of
of five thousand Eight hundred and thirty two pounds of tobacco and thereupon he brings Suite &c
