26 the afd Thomas and Sarah have Sustained by Occasion of the premisses afd We Command you that by the oath of honest and Lawfull men of your Bailywick or County you diligently Enquire what damages the said Thomas and Sarah have sustained as well by Occasion of the premises afd as for their Costs and Charges by them about their Suite in that Part Expended and that Inquisition which thereupon you shall take make you make Known to Our Justices of Our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of June next under your Seal and the Seal's of those by whose Oath you make the same Inquisition and have you then and there the Names of those by whose Oath you shall make that Inquisition and this writt Wittness Samuel Hopkins Gent Cheife Justice of Our said Court the 20th day of march in the Ninth Year of Our Dominion &c Ann Dom 1724 Thomas Hayward Cler Att which said third tuesday of June to witt the fifteeenth day of the same month ann Dom One thousand Seven hundred & twenty five being the day of the return of the said Writt Came as well the afd Plfts as the afd deft by their attorneys and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Came and made return thereof to the Court here Endorsed in these words following viz.t The Execution of this writt appears in a Certain S^c^hedule hereto annexed so answer Jos: MccClester Sherr June ye 14:th 1725 we of the Jury being duly Som.d and Qualifyed to Enquire into the premisses between Thomas Holbrook and Tobias Burke we find on Examination of Evidences that the premisses in the bill Exhibited against Sarah Holbrook Lately Called Sarah Shiles was true further We find that Tobias Burke Named in the said Bill did not make Oath to the Grand Jury on the said Bill therefore we find that the said Holbrook and his wife in the Bill Mentioned had not Caus of Action against the said Burk wittness Our hands and Seales the day and year afd
of Damages afd was Illegally Obtained &c therefore it is Considered of that the Writt afd with the Inquisition thereunto annexed be quashed and wholly held for Nothing &c
third Tuesday of June then next to answer unto Joseph MccClester Sheriff of said County of a plea of trespass upon the Case &c and that thereof he should not fail &c And the afd Joseph MccClester proceeded against the said Jonathan Raymond in the plea afd as followeth viz.t And whereupon the (said) |
