           June Court       1726                 269

Keep so that he might have her body before the Justices of his said Lordships County Court of Somersett
to be held at Dividing Creek the third tuesday of June then next to answer unto his said Lordship
Concerning a bill of Indictm.t against her found &c and that thereof he should not fail &c

       Att which said third tuesday of June to witt the twentieth day of the same month anno Dom one
thousand seven hundred and twenty seven being the day of the Return of the said Writt Cometh the
Sherr of Somersett County to whom the foregoeing Writt Was directed Com and makes return of the said
Writt to the Court here Endorsed in these words vizt   Cepi Corpus p Francis Allen sher

          Whereupon the afd Rosannah Cavanough being by the Sherr sett to the Barr Indictmt Read is
thereupon Instantly demanded how she would acquitt herselfe of the premisses afd by the Indictmt
above upon her Imposed says that she is in noe wise guilty thereof and for tryall thereof putts
herselfe upon the Country and George Dashiell who for his said Lordship in this behalfe Prosecuted
Likewise &c

                                   Thereupon Command is given to the sherr of Somersett County that Immediately
he Cause to Come here twelve &c by whom &c who neither &c to Recognize &c because as well &c
of which said Preceipt the Said Sherr to witt Francis Allen Gent Now hereat to witt the Same day &
Year Last mentioned makes Return that he hath here Ready twelve &c as by his said Preceipt
he was Commanded and the Jurors of that Jury therein Impannelled being Called Came to witt
W.m Holland, Robert Collier, Isaac Marshall, W.m Cord, Isaac Brittingham, W.m Dixon, John Purnall
Revell Horsey, Thomas Laws Thomas Peall, Charles Townsend and Bruffe Broughton who
being duely Elected tryed and Sworn to Say the truth in the premisses upon their Oath do say ^that the afd Rosannah Cavanough^
is guilty of the fornication whereof she stands Indicted &c

          Whereupon it was demaned of the afd Rosannah by the Court who was the father of the
Child she ^then^ stood Indicted for ^but^ Refuseth to declare the same

                   Therefore it is Considered by the Justices here that the afd Rosannah Cavanough be whipt
with ten Lashes on the Bare Back well Laid on untill the blood appear and that she be taken &.c
And thereupon as to the Corporall Punishm.t afd Command is given to the sherr of Somersett County
that he do thereof Immediate Execution according to the Judgmt afd ^rendered^ by whiping of the afd Rosannah
Cavanough at the Publick whiping Post with ten Lashes on the Bare Back well Laid on untill the blood
appear    and afterwards in the same Court the sherr Returns that he hath done the Execution of the
the Judgmt afd as to the Corporall Punishmt afd he was Commanded   whereupon the said Rosannah
Cavanough is ordered to give security for the severall Officers their fees due by Occasion of the Premisses
afd but for want thereof the said Rosannah Cavanough is Committed into the Custody of the sher
of Somersett County thereto Remain &c  And afterwards in the ^same^ Court Came a Certain Richard Holland
into Court in his proper person and became security of the afd Rosannah Cavanough and undertook to
pay ye several officers their fees due by means of the premisses afd upon the Indictmt afd thereupon
the afd Rosannah Cavanough is accordingly discharged &c
