268 Jurors of that Jury therein Impannelled being Called Came to witt William Holland Thomas Newbold W.m Dixon, Thomas Laws, Thomas Peal, Charles Townsend, Isaac Marshall, Will.m Corde, Isaac Brittingham George Benston ^Jno Hitch^ and Robert Collier who being duely Elected tryed and Sworn to Say the truth in the premisses ^afd^ upon their Oath do say that the afd William George is guilty of the felony ^afd^ whereof he stands Indicted as by the Indictmt above upon him Imposed Whereupon the Justices here ^according to act of assembly^ valued the Bell and Hoppells in the Indictm.t afd mentioned to forty pounds of tobacco Wherefore it is Considered by the Justices here that the afd William George pay unto the said John Lingly the party deprived four fold of the value of the Bell and Hoppells afd amounting in the whole to one hundred and sixty pounds of tobo (being valued to forty pounds of tobacco by the Justices as aforesaid) and that the said W.m George be whipt ^at the publick whiping post^ with ten Lashes on the bare back well Laid on untill the Blood appear and that he stand in the pillowry a quarter of an hour and that he be taken &c and thereupon as to the Corporall Punishm.t ^and pillowring^ afd Command is given to the Sherr of Somersett County that he do thereof Immediate Execution according to the Judgm.t afd Rendered by whiping of the afd Will.m George at the Publick whiping Post with ten Lashes on the Bare back well Laid on untill the the blood appear and by putting him in the Pillowry a quarter of an hour afterwards in the same Court ^came^ the sherr & Returned that he hath done the Execution of the Judgm.t afd as to the Corporall punishment ^and Pillowring^ afd he was Commanded thereupon the said William George is discharged from the Indictm.t afd he paying the severally Officers their fees due by occasion of the premisses afd &c
of his hon.rd father Samuel Brittingham is Left to the Care of your said Petitioner which Brother named Samuel is and Ever is Like so to Continue Lame on one side Both his arm and Legg being so bound whereby he is utterly uncapable of any Labour towards his maintainance and being arrived t the age of Sixteen is become a Taxable your Petitioner most humbly Prays your worships to Consider of his Lame and weake Condition and order that he may be Discharged from Paying of Taxes and your Petitioner as in Duty Bound Shall Ever Pray The petition afd being Read and heard and the premisses Considered It's thereupon ordered by the Court that the afd Samuel brother to the afd John Brittingham be for the future tax free as by the Pet.n afd is pray'd &c |
