25) afd in the County afd within the Jurisdiction of This Court Committed Fornication with a Certain Person to the Jurors altogether unknow by Means whereof the said Sarah afterwards to witt the Tenth day of Aprill One thousand seven hundred and fourteen at the Parish afd in the County afd was delivered of a Bastard Child againest Our Peace and Our Good rule and Dignity and also againest ye form of the Act of Assembly in Such Cases made and Provided &c which said Bill of Indictment so Ingrossed the said Tobias at the Court afd at Dividing Creek afd in the Country afd to the Grand Jurors at Our Court afd Before Our Justices afd to Inquire for us then and There Impannelled and Charged and Sworne falsely and Malitiously did Exhibitt and the afd Tobias altho' he well Knew all and Singular the Premisses in the Said Bill of Indictment Contained to be Falce Feigned and Contrary to Truth Then and There upon his Oath falsely Maliciously Wickedly and scandolously to the Grand Jurors afd did assert and affirm the matter in the said Bill so as afd Contained to be True when as in Truth the matter afd againest her the said Sarah in the Bill afd Contained above Specified was falce and Contrary to Truth and by the afd Tobias falsely ^wickedly^ and Malitiously Devidsed with intent to Molest defame and Perplex the said Sarah and after That the afd Tobias had Given Evidence as afd upo^n^ the Bill of Indictment afd to the afd Grand Jurors they the afd Grand Jurors then and There to witt at Our Court afd at Dividing Creek afd in the County afd to Our Justices afd Gave Their Answer That They of the Matter in the said Bill so as afd Contained were altogether Ignorant By Pretext of which Prosecution the Said Sarah not only in her Good name fame Credit State and reputation which Before was untouchd is Grevously hurt but also the said Thomas and Sarah divers sums of mony and Tobacco in and about the Purgation of the said Sarah in the Premisses afd to Expand and Lay out were and Are forced and Compeled and in Doing Divers their Lawfull Callings and Honest affaires are much hurt Hendred and made worse to their damage of Ten Thousand pounds of Tobacco as it is said and it is so far Proceeded in Our said Court That ye Said Thomas and Sarah Their damages by occation of the Premisses afd againest the afd Tobias Ought to recover But Because it is not Known what damages (the) |
