prayer of the plfts attorney is adjudged to give Special Bail to the action afd thereupon a Certain
William MccClammey in his proper person present in Court undertakes for the Said John Bishop
that if in Case the said Marke Scott Shall Recover Judgm.t in the plea afd against the Said John Bishop
or that the said John Bishop shall be therein Convict that then he the Said John Bishop
shall pay the Condemnation of the Court the C thereupon or render his body to the Custody ^of the sherrif^ of Somerset
County in Satisfaction thereof or that her the said William MccClammey will do it for him &c    thereupon
ye said John Bishop in his ^own^ proper person will doe it for her &c  ^apprs & Impl.s till next Court^

memorand.m the deft by his attorney sued out his Lordships Writt of Inquiry of
Damages which writt is as followeth viz.t  Somersett County fs Charles absolute
Lord and proprietary of the provinces of maryland & Avalon Lord Baron of
           Baltemore &c To the Sherr of Somersett County Greeting  Whereas a Certain Tobias Burke Late of
Stepney Parish in Somersett County Planter was attached of being in Our Court before Our Justices of
of Dividing Creek in Somersett County afd to answer unto Thomas Holbrook and Sarah his wife of
a plea wherefore the said Tobias being not Ignorant of the premisses of his own mere and wicked
Malice fore thought plotting and Malitiously Intending the said Sarah not Only in her good Name fame
Creditt Esteem ^&^ reputation afd to hurt detract Scandelize make worse and ^altogether to^ Blacken and her the said
sarah into the Evill Opinion and Esteem as well of all her Neighbours as other faith full Subjects of
Our Lord the King to Induce and ^to^ Create and Cause perpetual discord and difference between the said
sarah and Thomas Holbrook her husband but also to Cause her Innocently to be brought in danger of
suffering Corporall Punishment or foreiting six hundred pounds of Tobacco or Thirty shillings
as the Law in such Cases directs at our Court Held at Dividing ^Creek^ in Somersett County by Our Commissioners
and Justices of the Peace the third Tuesday of June Being the Sixteenth day of the Same Month in
the Ninth year of Our Dominion &c Annoqr Dom One thousand seven hundred and Twenty four
Present The worshipfull Mr Joseph Gray, Mr Samuel Hopkins, Mr William Whittington
Capt William Planner, Mr John Purnell, Capt John Jones, Capt William Fasett, Capt John Smith
William Stoughton Esqr, Capt John McClester, Mr John Handy ^and^ Mr James Dashiell, Our Justices
of the Peace in the County afd to Keep as also Divers feloney's Trespasses and Other Offences in the
said County Perpetrated to hear and Determine assigned a Certain Bill of Indictment falsely
and Maliciously di Cause to be Ingrossed for that the Said Sarah Holbrook Lastly Called
Sarah Shiles wife of the afd Thomas Holbrook Late of Stepney Parish in the County afd
Planter the tenth day of July One thousand seven Hundred and Thirteen at the Parish
