256 County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to Recognize &c because as well &c of which said preceipt the said Sherr to witt Francis Allen Gent now hereat this day to witt the same day and year Last mentioned makes Return that he hath here Ready twelve &c as by his said Preceipt he was Commanded and now hereafterwards to witt the same day and year Came as well the afd Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt Charles Cottingham, John Donelson, Henry Toadvine Christopher Glass, William MccClammey Isaac Marshall, Lewis Disharoon, Edward Beachamp, Cannon Winwright Giddion Tilman Mathew Purnall Henry Alexander who being duely Elected tryed & sworn to say the truth in the premisses upon their Oath do say that the afd Joseph Holder did assume upon himselfe in manner and form as the said Joseph MccClester above against him hath Complained and did did assess the damages of the same Joseph MccClester by occasion of the non performance of the promise and assumption afd beyound his Costs and Charges by him about his suite in that part Expended to One thousand and Eight pounds of tobacco and twenty two bushells of Indian Corn and for those Costs and Charges to one pounds of tobacco Therefore it is Considered that the afd Joseph MccClester Recover against the afd Joseph Holder One thousand and Eight Nine pounds of tobacco and twenty two bushells of Indian Corn his damages afd in form afd by the Jury assessed as also seven hundred and Nine Twelve pounds of tobacco for his Costs and Charges to the same Joseph MaClester by the Court here of his assent adjudged of Increase adjudged which Certain Damages in the whole do amount to seventeen hundred and twenty one pounds of tobacco and twenty ^two^ bushells of Indian Corn and the afd Deft in mercy &a
Jur of this Court was Indebted unto the sd Jos: in twelve hundred and Eighty pd.s of tob.o as by acco hereunto annexed may appear and being so thereof Indebted ye sd Isaac in Consideration thereof ye day and year afd at the place afd upon himselfe did assume & to ye sd Jos: then & there did faithfully promise y.t he ye sd Isaac ye sd twelve hundred and Eighty pd.s of tob.o to ye sd Jos: when he should be thereunto requested he would well and faithfully pay and Content & altho' ye sd Isaac ye sd twelve hundred & Eighty pounds of tob.o to ye sd Jos his promis & assumption afd in form afd made nothing Regarding but plotting and fraudulently Intending ye said Joseph in that part Craftilly and Subtilly to deceive and Defraud the said twelve hundred & Eighty pds of tobo to ye sd Jos: hath not paid altho' ye same to him hitherto to pay hath refused & Still doth refuse & deny to the damage of ye sd Jos of two thousand five hundred & sixty pd.s of tob.o & thereupon he Brings suite &c L Gale P Quer Pledges &c J Doe R Roe |
