hundred and twenty six at Somersett County afd within the Jurisdiction of this Court was Indebted
unto the said Joseph MccClester in the sum of Nineteen hundred and Eighty two pounds of
tobacco as by account hereunto annexed may appear and being so thereof Indebted the
Said Joseph in Consideration thereof the day and year afd at the place afd upon himselfe
did assume and to the said Joseph MccClester then and there did faithfully promise that
he the said Joseph Holder the said Nineteen hundred and Eighty two pounds of tobacco to
the said Joseph MccClester when he Should be thereunto requested the said Ninteen hundred
and Eighty two pounds of tobacco to the said Joseph MccClester according to his promise and
assumption afd in form afd made nothing regarding but plotting and fraudulently Intending
the said Joseph MccClester in that part Craftilly and Subtilly to deceive and Defraud the said
Eighteen ^Nineteen^ hundred and Eighty three two pounds of tobacco hath not paid altho' the same to
do the same Joseph Holder was often thereunto Requested but the same to him hitherto
to do hath Refused and Still doth Refuse and deny to the damage of the said Joseph
MccClester of three thousand pounds of tobacco and thereof he bringeth this suite &.c

    And the said Joseph Holder by George Dashiell his attorney Cometh and defendeth
the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court
and he hath it and the same day is given to the afd plft here also

       Att which said Next Court to witt the twenty first day of march anno Dom one thousand
seven hundred and twenty six Came again as well the afd Joseph MccClester as the afd
Joseph Holder by their attorneys afd and the said Joseph Holder by his said attorney as
before defends the force and Injury when &.c and says non assumsitt p patrium
the plft likewise
                                                    Thereupon Command is given to the sherr of Somersett
