it is Considered that the said Joseph MccClester Recover against the afd William West two thousand
and Ninety One pounds of tobacco his damages afd by the Justices afd in form afd assessed as also
433   four hundred & thirty three             pounds of tobacco for his Costs and Charges by him about
his suite in that part Expended by the Court hereunto the said Joseph ^by his assent^ adjudged and the afd deft
in mercy &a

Somersett fs    Thomas Baker late of Somersett County Planter al.s dict Thomas
Baker of Somersett was sumoned to answer unto Jacob Waggamon of a plea of
that he render unto him six pounds three shillings and six pence in Corn at twenty
pence p the bushell which to him he owes and from him he unjustly detaines &c
       And whereupon the afd Jacob by Levin Gale his attry saith that whereas ye afd Thomas ye
Eleventh day of June Anno Dom one thousand seven hundred & twenty five at Somrsett County
within the Jurisdiction of this Court by his Certain wrighting Obligatory Confessed himselfe
Bound unto the afd Jacob in ye afd six pd.s three shillings & six pence in Corn at twenty pence
p Bushell to be paid unto ye sd Jacob when thereof he should be required Nevertheless ye afd
Thomas altho' often required the afd six pd.s three Shillings and six pence to ye afd Jacob hath
not yet Rendered but the same to him hitherto to render denyeth and yet doth deny whereupon
he says that he is deteriorated and hath damage to the value of twelve pd.s and thereof
Brings Suite & offers here in Court the writing obligatory afd which ye Debt afd in form afd doth
testifie whose date is the same day and year abovesaid

    And the afd Thomas Baker by George Dashiell his attorney Comes and defends the force and
Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and
the same day is given to the afd Plft here also

             Att which said next Court to witt the twenty first day of march anno Dom one thousand seven hundred
and twenty six Came againe as well the afd Jacob Waggaman as by the afd Thomas Baker by their
attorneys afd and the afd Thomas by his said attorney says that he Cannot gainsay the action afd of
the afd Jacob nor but that he owes the afd six pounds ^three shillings & six pence^ to the afd Jacob in manner and form as the
afd Jacob against him hath Complained

             Therefore it is Considered by the Court that the afd Jacob Waggaman Recover against
631    the afd Thomas Baker six pounds three shillings and six pence his debt afd as also six hundred
631   and thirty one                    pounds of tobacco for his Costs and Damages to the same Jacob by
the Court here of his assent adjudged and the afd deft in mery &c memorand.m the plft relaseth
the penalty Reserving the principal debt and Interest untill paymt &c
