did faithfully promise that he the said William the said two thousand and Ninety One
pounds of tob.o to the said Joseph when he should be thereunto Requested he would well
and faithfully pay and Content and altho' the said William his promise and assumption
afd in forme afd made Nothing Regarding but Plotting and fraudulently Intending
the said Joseph in that part Craftilly and Subtilly to deceive and Defraud the said two
thousand and Ninety One pounds of tob.o to the said Jos hath not paid altho' the same to
do the said William was often thereunto Requested but the same to him hitherto to doe
hath Refused and still doth Refuse and Deny to the Damage of the said Joseph &c
four thousand one hundred and Eighty two pounds of tobacco and thereupon he brings

Jos: MccClester Late Sherr
       And the said William West in his Own proper person Comes and defends the force and
       Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he hath
       it and the Same day is given to the afd Plft here also

             Att which said next Court to witt the twenty first day of march Ann.o Dom one thousand
       seven hundred and twenty Six Came againe as well the afd Joseph ^by his attorney afd^ as the afd Will.m
       in his Own Proper person and the same William Says nothing in barr or avoydance
       of the action afd of the afd Joseph by which the same Joseph Remaineth against the
       afd deft thereof undefended &c

                   wherefore the afd Joseph his damages by Occasion of the non performance of
       the promise and assumption afd against the afd William Ought to Recover &.c whereupon
       at the prayer of the afd Joseph and by the Consent of the Same William the Justices here
       did assess the damages of the Same plantiffe by occasion of the Non performance of his
       promise and assumption afd beyond his Costs and Charges by him about his Suite in that
       part Expended to two thousand and Ninety One pounds of tobo
