which the afd Plft doth not gainsay      Whereupon the afd James MccMorie adm.r as afd by his
attorney afd prays that yin giveing security according to act of assembly in Such Case made and
Provided that the afd Sum of Twenty six pounds Sterr as of the rights and Creditts of the said
James Dalyel al.s Dalyzel so as afd Confessed in the hands of the said Hart Dashiell may
be Condemned in his hands towards satisfaction of the said James MccMories Damages and Costs &c

             Thereupon a Certain Joseph MccClester and John Donelson both of the County afd Gent
present here in Court undertakes for the said James MccMorie adm.r as afd according to act
of assembly that if in Case the said James Dalyel al.s Dalizell do at any time within a year
and a day appear and make all or any part of the said Claim against him appear to be satisfied
or otherwise to have been undue before the Laying of this attachm.t that then the
said James MccMorie adm.r as afd shall make Restitution unto the said James Dalyel
al.s Dalizell of all or Such part thereof as shall be made appear to be undue &.c or that
they the said Jos MccClester and John Donelson will do it for him &c

                   Therefore it is Considered that the afd sum of Twenty six pounds ster
so as afd Confessed be Condemned in the hands of the afd Hart Dashiell as of the rights
and Creditts of the afd James Dalyel al.s Dalizell towards satisfying unto the afd James
MccMorie his damages and Costs as also that the afd James MccMorie Recover agt the said
Hart Dashiell three hundred and thirteen                                   pounds of tob.o for his Costs
and Charges in that part Expended to the same James MccMorie by the Court here adjudged & yt
the afd James have thereof his Execution according to act of assembly Agt the said Hart
Dashiell &c         memorand.m the afd John Jones Garnishee as afd by the Consent of the
the plft voluntarily takes his oath that he hath none of the Effects of the afd James
Dalyell al.s Dalizell in his hands thereupon he is discharged &c

answer unto Jos: MccClester of a plea of trespass upon the Case &c
       And whereupon the said Jos by Levin Gale his attorney Complaines
that whereas the said William the tenth day of June Anno Dom one thousand seven hundred
and twenty six at Somersett County afd within the Jurisdiction of this Court was Indebted unto
the said Joseph in two thousand and NInety One pd.s of tobacco by Acc.o hereunto annexed
may appear and being so thereof Indebted the said William in Consideration thereof the day
and year afd at the place afd upon himselfe did assume and to the said Jos: then and there
