254 appear and answer unto the same James MccMorie in a plea of trespass upon the Case &c according to Law and that by good and Lawfull men of your Bailywick you make Known unto the person or persons in whose hands you make the same attachm.t y.t he or they be and appear before the Justices of our said County Court to be held as afd to shew Cause if any he she or they have why the same goods or Chattells rights or Creditts so attached in his her or their Hands ought not to be Condemned and Execution thereof had and made according to the forme of the Act of assembly in Such Case made and provided if to him her or them it Shall seem mete and how you shall Execute this Writt that you make Known unto our said Justices at the same day and place afd and have you then and there this Writt Wittness &c Att which said third tuesday of August to wit the Sixteenth day of the same month Anno Dom one thousand seven hundred and twenty Six Being the day of the Return of the said writt Cometh the afd James MccMorie admr of Jno MccMorie by his attorney and the sherr of Somersett County to Whome the foregoing writt was Directed Likewise Cometh & maketh Return thereof to the Court here Endorsed in these words vizt By vertue of the within writt to me directed I have attached Sixty pounds serling and fifteen hundred pd.s of tob.o in the hands of Cap.t John Jones Hast Dashiell and Alex.d Carlyle as the Effects of the within Named James Dalyel in their hands and have Sumoned them to be & appear before the Justices within Named at the day and place within mentioned to Shew Cause &c before Jno Doe and Richd Roe good and Lawfull men of my Bailywick as by the within writt I am Commanded so answers Francis Allen Sherr And the afd Hast Dashiell ^Garnishe of the same James Dalyell^ by George Dashiell his attorney Comes and defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he hath it and the Same day is given to the afd Plft also Att which said next Court to witt the fifteenth day of Novem Anno Dom One thousand Seven hundred and twenty Six Came againe as well the af James as the afd Hast by their attorneys afd and the said Hast by his ^said^ attorney prayed further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd plft here also Att which said Next Court to witt the twenty first day of march anno Dom one thousand seven hundred and twenty six Came again as well the afd James as the afd Hast by their attorneys afd and thereupon the Same attorney of the afd said James Dalyel al.s Dict James Dalizell to the value of twenty six pounds Ster nor but that the same ought to be Condemned in his hands for the said James MccMorie adm.r as afd of the rights and Creditts of the afd James Dalyel al.s Dalyzell which the |
