attorney as before defends the force and Injury when &c and say not guilty p the Country and
the Plft likewise
                                                    Thereupon Command is given to the Sherr of Somersett County this
Immediately he Caus to Come here twelve &c by whom &c who neither &c to Recognize &c because
as well &c of which said preceipt the said sherr to witt Francis Allen Gent now hereat this
day to witt the day and year Last mentioned Comes and makes Return that he hath here ready
twelve &c as by his said Preceipt he was Commanded and now here afterwards to witt the same
day and year Came as well the afd Plft as the afd defts by their attorneys afd and the Jurors of
that Jury therein Impannelled being Called Likewise Came to witt Charles Cottingham Henry Toadvine
Christopher Glass, W.m MccClammey, Isaac Marshall, Lewis Disharoon, John Beavens, Edward
Beachamp, Moses Driskill, Giddion Tillman, Mathew Purnall and Henry Allexander who being
duely Elected tryed and sworn to say the truth in the Premisses upon their Oath do say that the
afd John and Henry Polk are guilty of the Premisses as the afd William above against them Complained
and do assess the Damages of the same William by occasion of the premisses afd beyond
his Costs and Charges by him about his Suite in that part Expended to five pounds Curr.t mony and
for those Costs and Charges to one pounds of tobacco

                   Therefore it is Considered that the afd William Robinson Recover against the afd
John and Henry Polk Five Pounds Curr.t money and one pounds of tobacco his damages afd by
the Jury Afd in form afd assessed as also thirteen hundred and fifty five
pounds of tobacco which to the same William at his Request for his Costs and Charges afd by the Court
here of Increase adjudged which Certain Damages in the whole do amount unto five pounds Currt
money and thirteen hundred and fifty six                                                pounds of tobacco and the
afd defts in mercy &c

memord.m ye Plft by Levin Gale his attorney sued out his Lordship's
writt of attachm.t against the Deft the tennor whereof followeth in
these words vizt    Somrsett fs    Charles absolute Lord and proprietary
of the provinces of maryland & avalon Lord Baron of Baltemore
&c  To the sherr of Somersett County Greeting we Command you
that you attach any the goods Chattells rights or Creditts of James Dalyal late of Somersett County
Gent if they shall be found in your Bailywick to the value of sixty pd.s Sterr & fifteen ^hundred^ pd.s
of tob.o and when you have the same attached or any part thereof the same in your Costody
safe Keep so that you have the same before ye Justices of our County Court to be held at Dividing
Creek in Somersett County afd the third tuesday of August next then and there to be Condemned
according to Act of Assembly to & for the use of a Certain James MccMorie adm.r of ye goods and
Chattells &.c of John MccMorie dec.d unless the said James Dalyel by himselfe or his attorney shall
