Granted himselfe to be held and firmly Bound unto the same Benj.a in the sum of sixteen
thousand Nine hundred and Ninety Eight pounds of tob.o Good Merchantable tob.o and Caske
to be paid the said Benjamin when afterwards the said Will.m should be thereto required yet the afd W.m
tho' often thereto required the afd Sixteen thousand Nine hundred and Ninety Eight pd.s of tob.o & Caske
as afd or any part thereof hath not Rendered to the same Benj.a but the said W.m the same to
the afd Bej.a hitherto render hath altogether denyed and still doth deny whereby the said Benj.a
says he is worse and hath damages to the value of twenty thousand pounds of tob.o and thereof
he Brings this Suite &c   and the said Benj.a brings hereinto Court ye Writing Obligatory afd &c

    And the afd William Davis by George Dashiell his attorney Comes and defends the force and Injury when
&c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is
given to the afd Plft here also

             Att which said next Court to witt the sixteenth day of August Anno Dom One thousand seven
hundred and twenty six Came againe as well the Afd Benjamin as the afd William by their attorney
afd and the afd William by his said attorny prayed further Leave thereof of to Imparle here
untill the next Court and he hath it and the same day is given to the afd Benjamin here also

          Att which said next Court to witt the fifteenth day of November ann.o Dom one thousand
seven hundred and Twenty six Came againe as well the afd Benjamin as the afd William by their
attorneys afd and the afd William by his said attorney prayed further Leave thereof to Imparle
here unto untill the next Court and he hath it and the same day is given to the afd Benj.a here
also                     Att which said next Court to witt the afd twenty first day of march anno Dom
One thousand seven hundred and twenty six Came againe as well the afd Benjamin as the
afd William by their attorneys afd and the same attorney of the same William saith nothing
in Barr of or avoydance of the action afd of the afd Benjamin by which the afd Benjamin
Remaineth against the afd William thereof undefended &c

                Therefore it is Considered that the afd Benjamin Wailes Recover against the afd
William Davis sixteen thousand Nine hundred and Ninety Eight pounds of tobacco his debt afd
441   as also four hundred & forty One                                 pounds of tobacco for his damages
which he sustained as well by occasion of the detaining of the same debt as for his Costs and Charges
by him about his suit in that Part Expended to the same Benj.a by the Court hereof his assent
adjudged and the afd Deft in mercy &c
