1726 251 of March to witt the twenty first day of the same Month Anno Dom one thousand Seven hundred and twenty Six Being the day of the return of the said Writt Cometh the afd Jn.o Stevens by his said attorney afd and the Sherr of Somersett County to whome the foregoeing writt was Directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words vizt Non Est Inventus and Short note Left P Francis Allen sherr Whereupon the afd John Stevens by his attorney afd prayed that for as much as he hath Complyed with the Law in order to an attachm.t he may have Judgm.t against the afd Jos: Ja^c^kson for his Damages afd by way of attachm.t according to act of assembly &c whereupon for that it seemeth to the Court here that the afd Jno Stevens hath Complyed with the Law as alledged Therefore it is Considered by the Justices here that the afd Jno Stevens Recover against the afd Joseph Jackson as well the sum of two pounds five shillings and seven pence halfe peny his damages by occasion of the premisses afd as all Costs and Charges by the said Plft Laid out and 216 Expended about his suite by way of attachm.t against the goods Chattells and Creditts of the said Joseph Jackson According to Act of assembly in Such Case made and provided &c
Executrix of the last will and testament of Robert Martin Late of Somersett County Gent dec.d Lately in our County Court here to wit the twenty first day of June Anno Dom one thousand seven hundred and twenty six before Sam.l Hopkins Gent and his associates then our Justices of Somersett County Court (at Dividing Creek) and by Consideration of the same Court Recovered against Price Collins Late of Somersett County Planter al.s Dict Price Collins of the County afd Planter as well a Certain Debt of three thousand five hundred & Ninety six pd.s of tob.o three hundred and thirty two pd.s of Marchantable porke and ten Shillings & six pence Curr.t Money as also three hundred and Sixty two pounds of tob.o for her dam.s which she sustained as well by occasion of the detaining that same Debt as for her Costs and Charges by her about her suite in that part Expended whereof he is Convict as by the Record and process thereof in the same Court remaining manifestly appeareth and afterwards the afd Mary took to her Husband a Certain James Martin as by the Insinuations of the afd James and Mary in our Court before us at Dividing Creek we have Rec.d & altho' Judgm.t be thereupon Rendered notwithstanding Execution of the debt and Damages afd as yet Remaineth to be Done and because we are willing that those things which in our (Court) |
