1726 250 Att which said next Court to witt the fifteenth day of Novem.r ann.o Dom one thousand seven hundred and Twenty six Cometh againe as well the afd Cullett Owten as the afd William Jones by their attorney afd And the same attorney of the afd W.m saith nothing in bar or avoydance of the action afd of the afd Cullett by which the afd Plft Remains against the afd Deft thereof undefended by which the afd Cullett her damages by occasion of the Premises afd against the afd William ought to recover but because it is not known what damages the afd Cullett hath sustained as well by Occasion of the Premises afd as for her Costs and Charges by her about her suit in that part Expended therefore it is Considered the sher of Somersett County that by the Oath of honest and Lawfull men of his Bayliwick he diligently Enquire what Damages the afd Cullett hath sustained as well by Occasion of the Premisses afd as for her Costs and Charges by her about her Suite in that part Expended and the Inquisition which thereof he should take to his Lordships the Lord proprietary's Justices of the Peace at the next Court to be held for the County afd at dividing Creek the third tuesday of August march next under his seal and the seals of those by whose Oath he make the same Inquisition he send together with the writt thereof to him directed &c and the same day is given to the same W.m here also &c Att which said next Court to witt the twenty first day of march anno Dom One thousand seven hundred and twenty six Cometh the afd Cullett Owten by her attorney afd and the Sherr of Somersett County to witt Francis Allen Gent likewise Cometh and maketh Return of a Certain Inquisition taken before him at the house of M.r John Caldwell at Wickacomoco in the County afd the seventh day of February anno Dom one thousand seven hundred and twenty Six by the oath of twelve honest and Lawfull men of his bailywick by which it appears that the afd Cullett hath Sustained damages by Occasion of the Premisses afd besides her Costs and Charges by her about her suite in that part Expended to forty one Shillings Currt money of Maryland and for those Costs and Charges to one pound of tobacco Therefore it is Considered that the afd Cullett Owten Recover against the afd Wm Jones forty one shillings Curr.t money of maryland and one pounds of tobacco her damages afd by the Inquisition afd app in form afd appears as also one thousand three hundred & fifty five 355 pounds of tobacco to the same Cullett at her request for her Costs and Charges by the Court here of Increase adjudged which Certain Damages in the whole do amount unto and the afd deft in mercy &a
