24 manifestly appears Execution of the Judgm.t afd as yett remaines to be done as by the Insinuation of the Said Henry we have received and because we will those things which in Our Said Court are Rightly done and acknowledged should be brought to a due Execution &c We Command you that by good & Lawfull men of your Bailywick you make Known unto the person or said Jonathan Raymond yt he be & appear before the Justices of Our County Court to be held at Dividing Creek the third tuesday of march Next to shew Cause if anything for himselfe he hath or Knoweth to Say why the said Henry Toadvine should not have his Execution of the Judgm.t afd against him the Said Jonathan Raymond according to the form of the recovery afd he Ought not to have if to him it Shall Seem mete and have you then and there ^the^ Names of those before whom you make the same Known and this Writt Wittness Samuel Hopkins Gent Cheif Justice of Our Said Court the 11.th day of December in the Ninth Year of Our Dominion &c anno Dom 1724 Att which said third tuesday of March to witt the Sixteenth day of the same month anno Dom one thousand seven hundred & twenty four Came the afd Henry Toadvine by George Dashiell his attorney & the Sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh & Maketh return thereof Endorsed in these words following vizt Nihill p Jos: MaClester Sherr Therefore Command is againe Given to the Sherr of Somersett County that by good &c he make Known to the afd Jonathan Raymond that he be & appear before the Justices of his Lordships County Court to be held at Dividing Creek the third tuesday of June then next to Shew in form afd &c if &c and further &c the same day is given to the afd plft there also Att which said third tuesday of June to witt the fifteenth day of the same Month being the day of the return of the said Writt Came the afd Henry Toadvine by his attorney and the Sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh & maketh return thereof Endorsed in these words following vizt Nihill p Joseph MccClester Sherr And the afd Jonathan Raymond altho' Solemnly Called Came Not nor Shews Cause why &c but makes default whereby the afd Plft Remains against the afd Deft thereof undefended &c Therefore it is Considered by the Justices here the fifteenth day of June anno Dom One thousand seven hundred & twenty five that the afd Henry Toadvine Recover ag have Execution against the afd Jonathan Raymon of the Judgm.t afd as well for the Sum or quantity of two hundred & fifty Gall.s of Cyder Certain damages as also the Sum of two hundred & Ninty four ^pounds of tobacco^ Costs of Suite in the Judgm.t afd (284) specifyed as also the Sum of Two hundred and Eighty four pounds of tobacco by ye Court here adjudged unto him for his Costs and Damages sustained by Occasion of delay of Execution of the Judgm.t afd &c
