24 John Scarbrough foreman Thereupon Command is Given to the Sherr of Somersett County that he should take the said James Duncan if &c to answer &c and now hereafterwards to witt the fifteenth day of June ann Dom One thousand seven hundred and twenty five Came the said James Duncan in Custody of the Sherr of Somersett County and thereupon the Said James Duncan being by the Sherr sett to the barr (Indictm.t read) is Instantly demanded how he would acquitt himselfe of the premisses ^felony^ afd saith that of the felony afd as by the Indictm.t afd upon him is Imposed he is Guilty thereof and puts himselfe in Mercy of the Lord proprietary Wherefore it is Considered by the Court here that the afd James Duncan be whipt with twenty five Lashes on the bear Back well Laid on untill the blood appear and that he stand in the Pillowry One quarter of an hour and that he be taken &c And thereupon as to the Corporall punishm.t afd Command is Given to the Sherr of Somersett County that he do thereof Immediate Execution according to the Judgmt afd rendered by whiping the afd James Dencan with twenty five Lashes (on the bear Back well Laid on untill the blood appear) at the Publick whiping post and by setting him in the Pillowry one quarter of an hour and afterwards in the Same Court the Sherr Returns that he hath done the Execution of the Judgm.t afd as to the Corporall punishm.t afd he was Commanded &c and also it is Considered that the afd James Duncan pay unto Thomas Peal the Party deprived the four fold of the value of the ^tobacco^ gone afd stolen which amounts to One hundred & Sixty pounds of tobacco Wherefore It's Ordered that the said James Duncan Return home to his Master John Scotts Service and that the said Scott Return him to the County Court or Sherr of the County at the Expiration of his Servitude to reemburst to the County what tobacco has accrewed by Occasion of the premisses &c
Whereas a Certain Henry Toadvine of Somersett County planter Lately in Our County Court of Somersett to witt on the Eighteenth day of June in the Eighth Year of Our Dominion &c Ann Dom One thousand seven hundred & twenty three before the worshipfull Charles Ballard Gent and his associats Justices of Our said Court and by Consideration of Our said Court Recovered against a Certain Jonathan Raymond of Stepney Parish in Somersett County Planter as well the Sum or quantity of two hundred & fifty Gallons of Cyder Certain Damages as also the Sum of two hundred & Ninty four pounds of tobacco Costs of Suite by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this behalfe Laid Out and Expended &c whereof he is Convict as by the record & process thereof in Our Said Court remaining (manifestly) |
