1726 247 money to ye afd Jn.o Hath not paid but ye same to him hitherto to pay hath Denyed & Still doth deny whereupon ye same Jn.o Saith yt he is Deteriorated & hath Damage to ye value of forty pd.s Like money & thereof brings Suite &c And Brings hereinto Court ye writing obligatory afd which ye Debt afd doth testifie whose Date is ye Same day & year afd &.a J Donelson P Pson pledges &.c J Doe R Roe And whereupon ye afd Patrick Burn by Levin Gale his attry Comes & Defends ye force & Injury when &.a & says yt he Cannot gainsay ye action afd of ye afd Jn.o Donelson Neither Can he say but yt ye writing obligatory afd is his act & Deed & yt ye Debt therein Mentioned is yett due & unsatisfied wherefore ye afd Plft prays Judgm.t for his Debt afd & his Costs & Damages Sustained by occasion of ye Detaining of ye same Debt to him to be adjudged &a Therefore it is Considered yt ye afd Jno Donelson recover against ye afd Patrick Burn as well ye sum thirty pd.s Curr.t silver money of america his Debt afd as also 311 three hundred and Eleven pounds of Tob.o for his Damages which he sustained as well by occasion of ye Detaining of ye same Debt as for his Costs & Charges by him about his suite in yt part expended to ye same Jn.o by ye Court hereof his assent adjudged & ye afd Deft in Mercy &a
whereas the afd William in his LIfetime the Eighth day of March One thousand seven hundred and twenty at Somersett County afd within the Jurisdiction of this Court was Indebted unto the same Betty in the Sum of twenty five pounds ten Shillings and six pence Curr.t money of maryland and so thereof being Indebted the same William in his Lifetime afterwards to witt the same day and year afd at the County afd within the afd Jurisdiction in Consideration thereof upon himselfe assumed and to the Same Betty then and there did faithfully promise that he when afterwards ^he^ should be thereto required he the afd sum of twenty five pounds ten shillings and Six pence Curr.t money afd to the same Betty would well and faithfully Content and pay Nevertheless the said Esther whilst she was sole and the afd Isaac and Esther since the Espousalls between them Celebrated since the death of the said William the promise and assumption of the said William in his Lifetime so as afd made Little Regarding and plotting and fraudulently Intending the |
