note under ye hand of ye said Jn.o May in Court appear & ye said John being Indebted
as afd for & In Consideration afd at ye time & place afd upon hisselfe did assume yt ye
afd Sum of Six hundred pence he would well & faith truely pay by ye Day afd Nevertheless
ye said Jn.o his promise & assumption afd in forme afd made according to ye
tennor of his said Note he hath not regarded but plotting and fraudulently Intending
him ye said Peter to Deceive and Defraud ye afd six hundred pence ye sd Jn.o to
the said Peter hath not paid according to ye tennor of his said Note nor in anyways
Contented but ye same to pay hath Denied & still doth Denie to ye Dam of ye sd Peter
of twelve hundred pence & thereof he Brings Suite &a   Dashiell P Quer pledges &a J Doe Rd Roe

          A Copy of ye foregoing Decl.n was made & sent to be served on ye afd Jn.o Phipps
with ye Writt in ye plea afd &c                Att which said third tuesday of March to witt ye
twenty first Day of ye same Month Anno Dom one thousand seven hundred & twenty
six being ye Day of ye return of ye said Writt Cometh ye afd Peter Francis by his
attry afd & ye Sher of Somrsett Coty to whome ye foregoing Writt was Directed Likewise
Cometh & Maketh return thereof to ye Court here Endorsed in these words following
vizt vizt               Cepi Corpus Decln Delivered in time p me Francis Allen sher

             And whereupon ye afd Jn.o Phipps by Levin Gale his attry Comes & force &
Injury when &a and says yt he Cannot gainsay the action afd nor but yt he did assume
upon himselfe in Manner & forme as ye afd Jno Peter Freeny above against him hath
Complained Neither Can he say but yt ye afd Peter Freany hath Sustained Damage to
by occasion of ye Nonperformance of his promisse & assumption afd to six hundred pence &
the same Decl.n in all ye words before Expressly Confesseth &a

                Therefore it is Considered yt ye afd Peter Freany recover against ye afd Jn.o Phipps
as well ye sum of six hundred pence his Damages afd by him in his Decl.n afd above
253   Supposed as also ye sum of two hundred & fifty three                pounds of Tob.o
for his Costs and Charges by him about his Suite in yt part Expended to ye same Peter
Freany by ye Court hereof his assent adjudged & ye afd Deft in Mercy &a

         Patrick Burn of Somrsett County & province of maryland was
         Summoned to answer unto Jno Donelson of a plea yt he render unto
         him ye full & Just Sum of thirty pd.s Curr.t silver money of america
which to him he owes & Unjustly Detaines &a
   And whereupon ye same Jn.o in his own proper person saith yt whereas ye afd
Patrick ye fourth day of January Anno Dom one thousand seven hundred and
twenty six at Somrsett County afd within ye Jurisdiction of this Court by his
Certain Writing obligatory which ye same Jn.o with ye seal of ye afd Patrick
Sealed herein Court Brings whose Date is ye same day & year acknowledged himselfe
held & firmly Bound to ye afd Jn.o when afterwards he should be there unto required
yett ye afd Patrick altho' often thereunto required ye afd thirty pd.s Curr.t silver
