247 the same Betty in this Part to defraud and deceive neither the afd William in his life time nor the afd Esther since the death of the said William whilst she was sole nor the said Isaac & Esther since the Espousalls between them Celebrated the said sum of Twenty five pounds ten shillings and six pence Curr.t money afd or any part thereof to the same Betty hath not Paid nor for it in any wise Contented to the damage of the said Betty of Forty pounds Like money and thereof she bringeth this suite &c L Gale P Quer Pledges &a Jno Doe R Roe
P Betty Gale And the afd Isaac Morris in his own proper person Comes and defends the force and Injury when &c and says that he Can not gainsay the action afd nor Can he say but that the said Will.m Skirvan in his Life time did assume upon himself in manner and form as the afd Betty above hath Complained neither Can he say but that the said Betty Ought to Recover her damages by occasion of the Non Performance of the promise and assumption afd to Twenty five pounds ten shillings and Six Pence Curr.t money and the Same declaration in all the words before Expressly Confesseth &c Therefore it is Considered by the Court that the afd Betty Gale Recover against the afd Isaac Morris and Esther his wife Executrix of the afd William Skirvan Twenty five pounds ten shillings and six pence Curr.t mony her damages afd by her in her declaration above supposed as also three hundred and sixty pounds of tobacco for her Costs and Charges by her about her suite in that part Expended by the Court here to the same Betty of her assent adjudged to be Levied of the goods and Chattells which were of the afd William Skirvan at the time of his death in the hands of the afd Isaac and Esther Remaining to be administred if so much thereof in their hands they have and if so much thereof in their hands they have not then the Cost afd of the Proper goods and Chattells of the afd Isaac and Esther to be Levied and the afd defts in Mercy &c
Somersett to be held at Dividing Creek the third tuesday of march then next to answer unto Henry Toadvine of a plea of trespass upon the Case &c and that thereof he should not fail &c And the afd Henry Toadvine by George Dashiell his attorney Complains against the afd John Holder in the plea afd as followeth vizt Somersett fs John Holder late of Stepney parish |
