                 March Court       1726             246

       Att which said third tuesday of March to witt ye twenty first day of ye same
Month Anno Dom one thousand seven hundred & twenty six being the day
of the return of ye said Writt Cometh ye afd John Prise by his attry afd ye sher of
Somrsett County to whome ye foregoing writt was Directed Likewise Cometh and
Maketh return thereof to the Court here Endorsed in these words following
vizt                        Cepi Corpus Decln Delivered in time p me Francis Allen sher

And whereupon the afd John Phipps by Levin Gale his attorney Comes and defends the force
and Injury when &c and says that he Cannot gainsay the action afd nor but that he did
assume upon himselfe in manner and form as the afd John Prise above against him hath
Complained neither Can he Say but that the afd John Prise hath Sustained Damages by
Occasion of the non performance of his promise and assumption afd to five hundred
pence and the same declaration in all the words before Expressly Confesseth &c

                Therefore it is Considered that the afd John Prise Recover against the afd
John Phipps as well the sum of five hundred pence his damages afd by him in his declaration
253   afd above supposed as also the Sum of two hundred & fifty three               pounds
of tobo for his Costs and Charges by him about his suite in that Part Expended to the Same John
Prise by the Court here of his assent adjudged and the afd Deft in Mercy &a

Command was given to the Sherr of Somersett County that he should
take John Phipps late of Stepney Parish in Somersett County Schoolmaster
if he Should be found in his bailywick and him should safe keep so
       that he might have his body before the Justices of his Lordships County Court of Somersett to
       be held at Dividing Creek the third tuesday of march then next to answer unto Peter Freany
       of a plea of trespass upon the Case &c and that thereof he should not fail &c

             And the afd Peter Freany by George Dashiell his attorney Complains against the said
       Jn.o Phipps in the plea afd as followeth vizt

             Somersett fs   John Phipps late of Stepney Parish in Somersett County Schoolmaster
       was attached to answer unto Peter Freaney of Said County of a plea of trespass upon the
       Case &.c      And whereupon the same Peter P.r George Dashiell his attorney Complains
       that the afd John at Stepney Parish afd within the Jurisdiction of this Court on the twenty
       sixth day of October anno Dom One thousand seven hundred and Twenty five was Indebted
       unto the same Peter in the sum of six hundred pence to be paid in Pork or Corn by the
       Last day of December in the year One thousand seven hundred and twenty six as pr
