said Jos: then & there did faithfully Promisse yt he ye Said Solomon ye Said one
thousand nine hundred & thirty one pd.s of Tob.o to ye Said Jos: when he Should be thereunto
requested he would well & faithfully pay & Content & altho' the Said Solomon
he three hundred & Seventy Six five pd.s of Tob.o Pcell of the said Debt to ye said Jos:
he hath paid & Satisfied yett as to ye residue thereof being one thousand five
hundred & fifty Six pd.s of Tob.o ye said Solomon his promisse & assumption afd
in forme afd made nothing regarding but plotting & fraudulently Intending ye
Said Joseph in yt part Craftilly & Subtilly to deceive & Defraud ye said one thousand
five hundred & fifty Six pd.s of Tob.o to ye said Joseph hath not paid altho the
Same to doe ye said Solomon was often thereunto requested but the same to him
hitherto to pay hath refused & still doth refuse & deny to ye Dam: of the said
Joseph of three thousand one hundred & twelve pounds of Tob.o & thereupon

               A Copy of the foregoing Decln & acc.t were made & sent to be served on the
afd Solomon Tull with ye Writt in the plea afd &c

       Att which said third tuesday of March Nexxtto witt the twenty first day of the
Same Month Anno Dom one thousand seven hundred & twenty six being the day
of the return of the said Writt Cometh the afd Jos MaClester by his attry afd & ye sher
of Somrsett County to whome ye foregoing Writt was Directed Likewise Cometh and
maketh return thereof to the Court here Endorsed in these words following
vizt                                 Cepi Corpus Decl.n Delivered in time P me Fran Allen sher

       And the said Solomon Tull being present here in Court is at ye prayer of the
Plfts attry afd adjudged to give Speciall Bail to ye action afd thereupon a Certain
Lazarus Maddox Late of Somrsett County Planter Present here in Court undertakes
for ye said Solomon Tull yt if in Case ye afd Jos" MaClester shall recover agt
Judgment in the plea afd against the afd Solomon Tull or yt ye said solomon
shall be therein Convict yt then he the said Solomon Tull shall pay the Condemnation
of the Court thereupon or render his Body to the Costody of the sher
of Somrsett County in Satisfaction thereof or yt he ye said Lazarus Maddox
will do it for him &c

          Whereupon ye afd Solomon Tull in his own proper C person Comes & Defends
the force & Injury when &c and saith yt he Cannot gainsay ye action afd nor
but yt he did assume upon himselfe in manner & forme as the afd Jos: MaClester
above against him hath Complained nor Can he say but yt he did ye afd Jos:
MaClester hath Sustained Dam by occasion of the Non performance of
his promisse & assumption afd too one thousand five hundred & fifty six pds
