And Randell West both of Somrsett County Planters Present here in Court undertakes
for the said Anthony West y.t if in Case ye afd Jos: MaClester shall recover Judgm.t
in the plea afd against the afd Anthony West or yt ye said Anthony West Shall be therein
Convict yt then he ye said Anthony West shall pay the Condemnation of the Court
thereupon or render his Body to the Custody of the Sher: of Somrsett County in
Satisfaction thereof or yt they the sd Jn.o Phillips & Randell West will do it for
him &a                                                 And the afd Anthony West by George
Dashiell his attry Comes & Defends the force and Injury when &a and the same
attry says yt he is not Informed by the same Anthony his Clyant of any answer for
the same Deft to ye afd Plft in the plea afd to be given & Nothing Else thereof says
by which ye same Plft remaines against ye afd Deft thereof undefended
wherefore ye afd Jos: his Damages by occasion of the Nonperformance of the promisse
& assumption afd against the afd Anthony West ought to recover

          Whereupon at ye prayer of the afd Jos: MaClester & by the Consent of the afd
Anthony the Justices here according to act of assembly in such Case made & provided
did assess the Damages of Same Plft by occasion of ye non performance of the
promisse & assumption afd besides his Costs & Charges by him about his Suite
in yt part Expended to Twelve hundred & Eighty Eight pd.s of Tob.o

             Therefore it is Considered yt ye afd Jos MaClester Recover against ye afd
Anthony West twelve hundred & Eighty Eight pd.s of Tob.o his damages afd yt
part Justices afd in forme afd assessed as also the Sum of three hundred & thirty
332   Two                           pounds of tob.o for his Costs & Charges by him
about his suite in yt part Expended to ye same Jos: by the Court hereof his assent
adjudged & the afd Deft in Mercy &a

  Sollomon Tull
      Command was given to ye Sher of Somrsett County yt he should
take Solomon Tull Late of Somrsett County Planter if he should be found
in his Bailywick & him should Safe Keep so yt he might have
                   his Body before the Justices of his Lordships County Court of Somrsett
          to be held at Dividing Creek ye third tuesday of March then next to answer
    unto Joseph MaClester of a plea of Trespass upon the Case &c & that thereof he
    Should not fail &c               And the afd Joseph MaClester by Levin Gale his attry
    Declared against the afd Solomon Tull in the plea afd as followeth vizt

    Somrsett fs   Solomon Tull Late of Somrsett County Planter was attached to answer unto
                   Jos: MaClester of a plea of Trespass upon the Case &a

    And whereupon ye Said Jos: by Levin Gale his attry Complaines yt whereas ye sd Solomon
    the first day of Novem Anno Dom one thousand Seven hundred & twenty six at
    Somrsett County afd within ye Jur of this Court was Indebted unto ye said Joseph
    in one thousand Nine hundred & thirty one pd.s of Tob.o as by acc.t hereunto annexed
    may appear & being so thereof Indebted ye sd Solomon in Consideration thereof
    the day & year afd at ye place afd upon himselfe did assume & to the Said Joseph
