of Tob.o & the Same Decl.n in all the words before Expressly Confesseth &a

             Therefore it is Considered yt the said Jos: MaClester Recover against ye
afd Solomon Tull as well the sum of one thousand five hundred & fifty six
pds of Tob.o his damages afd by him in his declaration above supposed as
319   also the sum of three hundred & Nineteen          pounds of Tob.o for his
Costs & Charges by him about his suite in yt part Expended to ye same Joseph
by the Court hereof his assent adjudged & the afd Deft in Mercy &a

        Command was given to the sher of Somrsett County to
  yt he Should Take Phenix Hall Late of Somrsett County
Planter if he should be found in his Bailywick & him should be
Safe Keep so yt he might have his Body before the Justices of his Lordships
County Court of Somrsett to be held at Dividing Creek ye third tuesday of march
then Nexxto answer unto Jos: MaClester of a plea of Trespass upon ye Case &c
& yt thereof he should fail &a   And the afd Jos: MaClester by Levin Gale his
attry Declared against the afd Phenix Hall in ye plea afd as followeth vizt

Somrsett fs   Phenix Hall Junr Late of Somrsett County Planter was attached to
          answer unto Joseph MaClester of a plea of Trespass upon ye Case &a

And whereupon the said Jos: by Levin Gale his attry Complaines yt whereas ye
said Phenix ye first day of Novem.r Anno Dom one thousand seven hundred
twenty six at Somrsett County afd within the Jurisdiction of this Court was
Indebted unto ye said Jos: in Eleven hundred thirty five pounds of Tob.o as by
acc.t hereunto annexed may appear & being so thereof Indebted the said Phenix
in Consideration thereof the day & year afd at ye place afd upon himselfe did
assume & to the said Jos: then & there did faithfully Promisse yt he ye sd Phenix
the said Eleven hundred thirty five pd.s of Tob.o to ye sd Jos: when he should be
thereunto requested he would well & faithfully pay & Content & altho' ye sd
Phenix three hundred & one pd.s of Tob.o pcell of the said Debt to ye said Joseph
he hath paid & satisfied yett as to ye residue thereof being Eight hundred
thirty and four pounds of Tob.o the said Phenix his promisse & assumption
afd in forme afd made Nothing regarding but plotting & fraudulently intending
ye said Joseph in yt part Craftilly & Subtilly to deceive & Defraud the said
Eight hundred & thirty four pounds of Tob.o to ye sd Jos: hath not paid altho' ye
same to doe the said Phenix was often thereunto requested but the same to
him hitherto to pay hath refused & Still doth refuse & Deny to ye Damage of ye
said Joseph of sixteen hundred pounds of Tob.o & there upon he Brings Suite
