Seven hundred & twenty Six at Somrsett County within ye Jur of this Court was
Indebted to ye afd Jos in the sum of Nineteen hundred pds of Tob.o as by acc.t here with
in Court produced may appear & so thereof being Indebted ye said Anthony in Consideration
thereof afterwards to witt ye Same day & year afd at ye Co.ty afd & within ye afd Jno
upon himselfe assumed & to ye Same Joseph then & there faithfully promissed yt he
when afterwards he shou'd be thereunto requested he ye afd Sum of Nineteeen hundred
pd.s of Tob.o to ye Same Jos; he wou'd well & faithfully Content & pay Nevertheless ye sd Anthony
his promisse & assumption afd in forme afd made Little regarding & plotting & fraudulently
Intending ye same Jos: in this part Craftilly & Subtilly to defraud & deceive he
the afd Sum of Nineteen hundred pd.s of Tob.o or any part thereof to the Same ^Joseph^ (although
afterwards to witt the same day & year afd at ye County afd & within ye afd Jur he was
thereto requested) hath not paid or him for it in anywis Contented but ye same Anthony
the same hitherto to doe hath altogether refused & still doth refuse & hereby the
same Joseph says he is the worse hath Dam to ye value of four thousand pd.s of Tob.o
& thereof he Brings this Suite &a      L Gale P Quer pledges &.a Jno Doe Richd Roe
