Cometh and Maketh return thereof to the Court here Endorsed in these words Following
vizt                                 Cepi Corpus Decl.n Delivered in time p me Francis Allen Sher

       And the said Rodah Bowin being present here in Court is at the prayer of
the Plfts attry afd adjudged to give Speciall Bayle to the action afd thereupon a Certain
William Fasitt of Somrsett County Gent present here in Court undertakes
for the said Rodah Bowin yt if in Case ye afd Jos MaClester shall Recover Judgm.t
in the plea afd against the afd Rodah Bowin or yt ye said rodah Bowin shall be
therein Convict yt then she ye said Rodah Bowin shall pay the Condemnation
of the Court thereupon or render her body to the Costody of the sher of Somrsett
County in satisfaction thereof or yt ye said Will.m Fasitt will do it for her &c

       Whereupon a C the afd Rodah Bowin in her own proper person Comes and
Defends the force and Injury when &c   & saith yt she Cannot Deny gainsay ye
action afd nor but yt she did assume upon herselfe in manner & forme as the
afd Jos: MaClester above against her Complained nor Can she say but that ye afd
Jos: hath Sustained Damages by occasion of ye nonperformance of her promisse
& assumption afd to one thousand two hundred & sixty pd.s of Tob.o & ye same
Declaration in all the words before Expressly Confesseth

       Therefore it is Considered yt ye afd Jos: MaClester Recover against ye afd rodah
Bowin as well ye sum of one thousand two hundred & sixty pds of Tob.o his dam
afd by him in his declaration above supposed as also ye sum of three hundred and
323   Twenty three            pounds of Tob.o for his Costs & Charges By him
about his Suite in yt part Expended to ye same Jos: by ye Court here of his
assent adjudged and the afd Deft in Mercy &a

     James Perry
Command was given to the Sherr of Somersett County that he should take
James Perry Late of Somersett County planter if he should be found in
his Bailywick and him should safe keep so that he might have his Body before
the Justices of his Lordships County Court of Somersett to be held at Dividing Creek the
third tuesday of march then next to answer unto Jos: MccClester of a plea of trespass upon the
Case &c      and that thereof he should not fail &c      And the afd Jos: MccClester by Levin
Gale his attorney proceeded against the said James Perry in ye plea fd as followeth vizt

Somersett fs   James Perry Late of Somersett County planter was attached to answer unto Jos:
MccClester of a plea of trespass upon the Case &c

       And whereupon the said Jos: by Levin Gale his attorney Complaines that whereas the said
James the first day of Novem Anno Dom one thousand seven hundred and twenty six at Somersett
County afd within the Jurisdiction of this Court wad Indebted unto the said Jos: in one thousand
and fifty five pounds of tob.o as by acc.o hereunto annexed may appear and being so thereof
being Indebted the said James in Consideration thereof the day and year afd at ye place afd upon
