shall be found in his Bailywick & her should safe Keep so that he might have her
Body before the Justices of ^his Lordships^ our County Court of Somrsett to be held at Dividing
Creek the third tuesday of March then next to answer unto Joseph MccClester
of a plea of Trespass upon the Case &c   and that thereof she should not
fail &c         And the afd Joseph MccClester by Levin Gale his attry Proceeded
against the said Rodah Bowin in the plea afd as followeth viz.t

Somrsett fs   Rodah Bowin Late of Somrsett County Widdow was attached to
answer unto Jos: MaClester of a plea of Trespass upon the Case &c

        And whereupon ye said Joseph by Levin Gale his attry Complaines yt whereas
ye sd Rodah ye first day of Novem anno Dom one thousand Seven hundred &
twenty Six at Somrsett County afd within ye Jur of this Court was Indebted unto
the said Jos: in one thousand five hundred & Ninety pd.s of Tob.o as by acc.t
hereunto annexed may appear & being so thereof Indebted ye said Rodah in
Consideration thereof ye day & year afd at the place afd upon herselfe did
assume & to ye said Jos: then & there did faithfully Proimisse yt she ye sd Rodah
ye said one thousand five hundred & Ninety pd.s of Tob.o to ye said Jos: when
She should be thereunto requested she would well & faithfully pay & Content
& altho' ye sd Rodah three hundred and thirty pd.s of Tob.o pcell of ye said Debt to ye
said Jos: she hath paid & satisfied yett as to ye residue thereof being one thousand
two hundred & sixty pd.s of Tob.o to ye sd Rodah her promisse & assumption
afd in forme afd made Nothing regarding but plotting & fraudulently Intending
the said Jos: in yt part Craftilly & Subtilly to Deceive & Defraud ye sd
one thousand two hundred & sixty pd.s of Tob.o to ye said Jos: hath not paid
altho' the same to doe ye sd rodah was often thereunto requested but ye same to
him hitherto to pay hath refused & Still doth refuse & deny to the damage
of the said Jos: of two thousand five hundred & twenty pds of Tob.o & thereof he
