himselfe did assume and to the said Jos: then and there did faithfully promise that he the said James
the said one thousand and fifty five pounds of tob.o to the said Jos when he should be thereunto
Requested he would well and faithfully pay and Content and altho the said James Ninety one
pounds of tob.o percell of the said Debt to the said Jos: he hath paid and satisfied yet as to
the Residue thereof being Nine hundred sixty and four pounds of tob.o ye said James his
promise and assumption afd in forme afd made nothing Regarding but plotting & fraudulently
Intending the said Jos: in that part Craftilly and Subtilly to Deceive & defraud the
said Nine hundred and forty four pounds of tob.o to the said Jos: hath not paid altho the same
to Doe the said James was often thereunto Requested but the same to him hitherto to pay hath
Refused and still doth Refuse and Deny to the damage of the said Jos: of Nineteen hundred
and twenty Eight pounds of tob.o & Thereupon he Brings Suite &c   L Gale P Quer pledges &c J Doe R Roe

       A Copy of the foregoing declaration and acc.o were made and sent to be served on the afd
       James Perry with the writt in the plea afd &c

                Att which said third tuesday of march to witt the twenty first day of the same month
       anno Dom one thousand seven hundred and twenty Six being the day of the Return of the said
       writt Cometh the afd Jos: MccClester by his attorney afd and the sherr of Somersett County to
       whome the foregoeing writ was Directed Likewis Cometh and maketh Return thereof to ye
       Court here endorsed in these words following viz.t Cepi Corpus decl.n del.d in time P me Fran Allen Sherr

             And the said James Perry being present here in Court is at the prayer of the plfts
       attorney afd adjudged to give speciall Bail to the action afd thereupon a Certain Tho.s Collins
       of the County of Somersett Gent planter present here in Court undertakes for the said
       James Perry that if in Case the afd Jos: MccClester shall Recover Judgm.t in the plea afd ag.t
       the afd James Perry or that the said James Perry Shall be therein Convict that then he
       the said James Perry Shall pay the Condemnation of the Court thereupon or render
       his Body to the Costody of the Sherr of Somrsett County in Satisfaction thereof or that
       he the said Thomas Collins will do it for him &c
