                  A Copy of the foregoing decln & acc.t were made & Sent to be Served on
the afd Isaac Noble with the Writt in the plea afd &a

                 Att which said third tuesday of march next to witt the twenty first day of
the same Month Anno Dom one thousand seven hundred & twenty six being the day
of the return of the said ^writt^ Cometh the afd Joseph MaClester by his attry afd and
the sher of Somrsett County to whome the foregoing Writt was Directed Likewise
Cometh & Maketh return thereof to the Court here Endorsed in these
words vizt                            Cepi Corpus decln Delivered in time P Fran Allen sher

          And the afd Isaac Noble by Geo: Dashiell his attry Comes & Defends
the force and Injury when &a               and saith he Cannot Deny the action
afd nor but that he did upon himselfe assume in manner and form as ye
afd Joseph MaClester above against him supposed nor can he deny but yt
the afd Joseph hath Sustained Damages by occasion of the non performance
of his promisse & assumption afd to Five hundred & fifteen pounds of
Tob.o and the same Declaration before Expressly Confesseth &a

             Therefore it is Considered by the Court that the afd Joseph MaClester
recover against the afd Isaac Noble as well the sum of Five hundred
& fifteen pounds of Tob.o his Damages ^afd^ in forme afd Confessed as also the
277   sum of Two hundred & seventy Seven      pounds of Tob.o for his Costs and
by Charges by him about his Suite in that part Expended To ye same Joseph
by the Court here of his assent adjudged and the afd Deft in Mercy &a

Peter Freney
Command was given to the sherr of Somersett County that he Should Take Peter

Freney late of Somerset County planter if he should be found in his Bailywick
and him should safe Keep so that he might have his Body before the Justices of his Lordships County
Court of Somersett to be held at Dividing Creek ^the third tuesday of March^ then next to answer unto Jos MaClester in a plea of
trespass upon the Case &c and that thereof he should not fail &c

          And the afd Jos MaClester by Levin Gale his attorney proceeded against the afd Peter freney
in the plea afd as followeth viz.t
